VETERANS AFFAIRS - OUR TROOPS!

Reading the courts documentation, I find it hard to believe that a City Court office can range higher in jurisdiction than that of  Federal one. However that seems to be the case in Aiken, South Carolina. Mr. Dotson, a former member of the US military is being overrun by common law in a Family court case. Below the current running scenerio:

"A South Carolina Court is violating disability pay laws in my case concerning spousal support. I am a 100% bodily disabled veteran, and in the middle of a divorce. The court is forcing me to pay an unjustified amount of spousel support and in collection my wife's attorney fee. I was in the US Army and sustained major spinal injuries while going to the aid of a injured soldier. While becoming disabled my spouse has numerious amounts of times abandoned my person with no help whatsoever, she did so by means of leaving me for other agendas, such as as another man clear across the country, keeping in mind that I was completely in need of a caretaker and required physical assistance from my wife. For the majority our marriage (9 years), she had total control over the financial accounts, plundering the assets without my knowledge, sending money to her family members, buying computers for friends and paying other peoples lives with my disability pay. She withheld mail from me because the bill collectors had sought after the payments, which she had priorly made using our family name. I was on medication after my accident which kept me for the most part in bed or awake during the primary hours of the day or night. She did not work. I had by coincidence found out that she had sent my medication (morphine) to her secret boyfriend by mail (a police officer in Tenneesee). Coherently, she almost had my disability benefits, which is paying for both our exsistense relinguished thru her milicious action. My brother-in-law caught her doing this and the rest of the above had been slowly but surely uncovered.  However after I had found out 5 years has passed, while uncovering this she no longer wants to be married to me and took off again in January 2007. I had to call my parents, whom are seniors and also lifers in the US military from out of town to assist me, as well had to call an aunt whom now takes care of me in my home. My wifes first attempt was to move to her boyfriends in Tenneessee, whom then did not want her anymore, then moving to a friend of hers there, whom threw her out after several months and then she tried to move back in with me and found out that I had my aunt taking care of me, so she moved in with her sister, yet tells the court she is living in a home for battered women now.  At the latter point my soon to be ex-wife is now demanding spousal support, her attorney here in Aiken SC filed for spousel support and I should pay for her continued malicious behavior of disconcerment. Together they are attacking my disability benefits and I stand alone. They want me to pay for her car payments, her living expences, continue to finance her new way of living and pay spousel support. I am also to pay her attorney fees within the next few days or go to jail. I believe my attorney is overwelmed with his job to protect me from the outcome of this, and knows very little of this sector of law. I need help and your signature so to be able to give to the presiding Judge in South Carolina.

Despite Federal Law protecting this pay from spousel support. This pay is protected under US code 38 15301, this pay is not divisable by third parties. Even though this has been said to the Judge, it is being ignored to the fullest extent. It is time that Congress and the Senate enforces this law and protect disabled veterans. Please sign this petition and protect disabled veterans.  They are taking money from a disabled person and assigning it to a able bodied person. It is time that Congress and the Senate, pass legislation protecting the disabled. While the able bodied person can improve their life the disabled person cannot. Please sign and ask the Senate and Congress immediately pass legislation, and support those that have supported this country. And this will protect our troops that are in harms way now, who may become disabled."

This strongly reminds of an outcome of the Vietnam war, where many soldiers had been left by their wives due to disability, when they came back home, however back then these wives weren`t so cruel hearted to sue for support nor had such been granted to continue such a lifestyle. And besides this, what does this military wife make the rest of the good wives look like?

This is an absolute outrage which can happen to any other member of the military in the future. Female or male! We can not stand for Federal laws being twisted and deliberately misused by State courts and attorneys whom find ways to burden the disabled Veteran more than he/she already has to endure. Hinse we are powerless against the Gov. to actively help the "active duty troops" being that they are in various parts of this world, thats is ever so more the reason why we need to show our "active help to our Veterans" on the homefront!

I have watched this tragedy unfold, and it was difficult to see what suffering this woman placed on my son. I was there when Jimmy had to close his bank account and open a new one. I was there when he called the loan company, when he was shocked to hear his wife had not made payments from DEC.2005 up to March of 2006. The vehicle was being repossesed. This was the vehicle she ran to Tenn. with. I heard my son beg the loan company to work with him, and how it took most of his next months check to catch up with this loan, he had nothing left to even eat with. If it were not support from his mother and myself, Jimmy would have starved. Now it disgusts me, because the courts did not see this, yet his wife and her attorney shamelessly petition the courts to reward bad behavior. please help my son and sign this petition. He and all Disabled Veterans need your help. I would like to add one more thing, social security my son is receiving is $1,000.00 a month, his able bodied wife is entitled to 600 dollars of this. Leaving the disabled person only 400. I cannot see where anyone can call this justice. We have contacted VA and State Representatives. We have received no word, as this issue they pass off as civil. Then one must ask, what is their function, to pass laws. If they are in support of our troops, then lets see it by actions, because actions are louder then words. So to all our Political Leaders, stand up and do what is right, we will remember where each one stood when the next election comes.
