A recent new homeowner submitted an Architectural Request Form to the Tiehen Group with forged signatures of the two adjoining property owners. Not the Board but one board member approved without anyone consulting the City regarding the codes for installing an outdoor above ground hot tub on a 12x12 concrete pad. The request had not only forged signatures but no building permit which is required and involves the following:
A completed permit application. Two plot plans. The plot plan must include property address, legal description, property dimensions, and easements. If you do not have a plot plan, one may be available for you by contacting the Codes Administration Division at City Hall, 913-339-6700, extension 170. Verification that the proposed hot tub is UL approved. This can be through a brochure about the proposed hot tub. Information indicating compliance for entrapment protection must be provided. A fence is required to confine a hot tub. A four foot fence may be constructed within and along all interior side and rear yards, but is not permitted in front of the building or line of the building as it extends to the side property line, or beyond the building line on the street side setback of a corner lot. A six foot fence may be erected within three feet of the hot tub, or within three feet of a patio or deck supporting the hot tub. Openings in the fence shall not allow the passage of a 4-inch diameter sphere. Gates for pedestrian access must open outward away from the pool, be self-closing and have a self-latching device. Gates other than pedestrian gates shall have a self-latching device. The release mechanism of the self-latching device must be at least 54 inches from the bottom of the gate, unless the mechanism is located on the pool side of the gate at least three inches below the top of the gate and the gate and barrier (fence) have no openings greater than one-half inch within 18 inches of the release mechanism. Access gates shall be equipped to accommodate a locking device. Construction value of the proposed hot tub work.
