Allow Shari Tackert to continue to operate All Things New by Shari and Camryn's Cottage at her residence

Shari Tackert has been painting furniture in the workshop at residence for the past two years with no complaint. Shari's goal with All Things New by Shari is to help bring beauty and new life to her clients' pieces of furniture. On many occasions, this business has contributed to many benefits, auctions, and fundraisers as a support to the community. Only two or three pickups of furniture are made per month and Shari works in the shop approximately ten hours a week or less.

Last fall, Shari and her husband converted their former pool house into a beautiful guesthouse and garden for others to rent on a nightly basis to enjoy. In March of this year, she opened up Camryn's Cottage as a bed and breakfast. Shari speaks by phone to every potential guest who wishes to book the cottage. The clientele consists mostly of women who come to Brenham to shop at the antique shows in Round Top or other cultural local events, such as the Bluebonnet Festival. She would never invite anyone to stay in the cottage she does not approve of as she has her family's best interest of utmost concern, including a beautiful seventeen-year-old daughter.

The Deed Restrictions of Sandy Creek Estates related to operating a business at a residence are vague and ambiguous. Many residents have never been made aware that there are any deed restrictions at all. The wording in item I of the document says, "All lots in the tract or subdivision shall be described as residential lots." The residence at 5680 Hillside is definitely the Tackert family residence as they have lived there for three years. In item V of the document, it states, "No noxious or offensive trade shall be permitted on any tract..." Previous court trials have set precedent that furniture painting is not considered "noxious or offensive." Thirdly, item XIV of the document indicates that the Deed Restrictions are to continue to be valid unless the majority of the owners agree to a change. There are currently several home-based businesses in Sandy Creek Estates who have been allowed to continue their existence without complaint.

Therefore, Shari is asking for your support in allowing these two businesses to continue to be operated at her home.
