Indiabulls Greens’ Home buyers stand together for amenities(Hospital, School, Clubhouse) & possession, promised by the builder.

On behalf of flat owners of Indiabulls Greens, Panvel project, the following is a summary of the bouquet of False promises, Coercive behaviour and one sided Agreements signed by us in very compelling circumstances, reflecting the greed and impunity with which Indiabulls has dealt with the common public.
In 2009 Indibulls launched a mini township project on an approx. 25 ( it should be 80 or 83)acre plot, well located near the upcoming International Airport, promising a Super Built ratio, International School, Hospital, Luxurious Club (including a gym/ swimming pool/ sports facilities)shopping areas(Mega Mall)/ 24 hour power back up/ dedicated bus service to & fro to the train/ bus station at Panvel). The also promised widespread Greenery in the form of small forest like ambience. All great reasons to buy a flat and enjoy the benefits of community living.
The initial promise for delivery was 2 years for those who deposited initial amount of Rs.1 lakh in 2009.
Thereafter the Customer Service Department of India Bulls showed spirited response ( or aggressive postures) to delayed payments, demanding interest & penalty at 18%, while ignoring all requests for information on project schedules and progress.
A year later, with the green clearance coming through, the airport project got off the ground, leading to a spurt in realty rates nearby. The size of Indiabulls Greens, too, increased to 80 acres, with the launch of Phase 2 and with it the nightmares of the Phase I buyers started.
* Each tower height was increased from 15 to 33 floors
* The Super Built-up payable area was jacked up by about 25% with effectively NO increase in carpet area
* Original building numbers were changed along with the flat layout
* All amenities promised with Phase 1 were now shifted to the new Phases. are not there in Phase 1. These amenities have vanished with the change in plans which accommodated Rental Housing Scheme of MHADA. The grandiose Club MOSS and a luxurious lifestyle was promoted through extravagant advertisements. Of course, they forgot to mention that the phase I flat owners would have to travel about 1 km on a municipal road to access these facilities.
Shocked flat owners were offered a Hobson's choice by smug customer service executives - Pay as per the revised super built up area and layout or accept termination after deduction of 15% per cent of the apartment cost as cancellation charges (20% of the flat costs had already been collected by them)
* In many cases higher floors were allotted to those who had booked on lower floors and FORCED to pay the increased floor rise charges (pay or cancel)
* Any payment delay would attract 18% penalty (pay or cancel).But in case of cancellation of booking by India Bulls they would pay only 6% interest as per Agreement.
* One sided Contracts were thrust upon us (sign or cancel).Some Customers were shown the Agreement for signing at the Registrar’s Office only.
*Some of the one sided clauses of the Agreement-
(1) Customer cannot dispute completion of work as stated in Demand Letter of Promoter.
(2) Purchaser has been explained about FSI.
(3) Purchaser cannot question that he is getting less light or Air.
(4)Purchaser has agreed to increase and decrease in Common facilities.
(5) with signing of agreement all prior understandings superseded.

* Some of us had to go to Panvel twice to sign a "Deed of Rectification" as the original tower numbers alloted were incorrect (e.g. 18 H was renamed to 18 E). The inconvenience, for an absurd mistake on their part, was dealt with characteristic arrogance (sign or cancel)
* Those who cancelled received refunds many months late (in some cases 6 months)....
*Many customers who booked the flat in 2009/ 2010 intending to take possession and stay there after retirement are now frustrated. Secondly many Customers are paying both EMI to Bank and Financial institutions and Rent to Landlord.
NOTE:
They cited a bigger clubhouse (Club Moss), more staircases and three lifts as the reason for the increase in cost. The increased rates also included charges under newer heads, such as government amenities, society formation and share money that were not part of the original deal.
Almost towards the end of 2016 now. There is no sign yet, of the flats being handed over. This township comprising of over Three Thousand Five Hundred flats is now expected to share minimal amenities which seem to be disappearing or diminishing day by day. Of course a reincarnated customer service will start communicating when the next payments are due, with no memory of promises made and their favorite advice ....DO WHAT YOU WANT.

We are signing this petition to get attention of the Govt authorities to look into this matter on an urgent basis and Ensure that Possession of flats are given with O.C. C.C. and all Amenities / Facilities advertised and promised to us.

Within 24 hours we have been able to get almost 120+ signatures. I believe there are almost 3000 customers who have considered investing in this project. Request you to share this petition as much as possible.
PS: Have closed the cloned petition which was signed by 9 members.
