Small Scale Miners Mandate

Amendment to add additional clauses to Oregon Revised Statues 517.120 - 517.135 which addresses the statutory right to mine, prospect and explore.
We the Small Scale Miners of Oregon and surrounding Western States stand behind this petition for just cause.

We believe the State of Oregon must support and protect its heritage and the Men & Women of this Country who through a specific lifestyle have contributed immensly to the economic benefit to this state as well as neighboring western states.

We ask that you introduce the Small Scale Miners Mandate as written below into legislation and research our cause to be free from Environmental Legislation and Beaurocratic scrutiny for a De-Minimus Impact proven by peer reviewed Science based studies.

We Support:
The SMALL SCALE MINERS MANDATE is 4 simple clauses added to the State Of Oregons Legislative Law under ORS 517

1. The State of Oregon recognizes that Small Scale Mining Operations, Operators & and Motorized Equipment used in Placer Gold Suction Dredge Mining of 8" Nozzle size or less, Motorized Equipment shall not exceed 40 HP, are Small Scale Operations deemed by this ruling as Small Scale Operations by nature and by operations in general, and receive full protections and exemptions under Mineral Extraction Laws by Federal and State Statue.

2. The State of Oregon exempts from Fees for Small Scale Operations under any Agency, Department, State Office, Federal Government Office, all Small Scale Operations & Motorized Equipment as deemed Small Scale in nature by SMALL SCALE MINER MANDATE (1).

3. The State of Oregon grants Incidental Take to the Small Scale Operations & Motorized Equipment deemed Small Scale Operation(s) by SMALL SCALE MINER MANDATE (1).

4. The State of Oregon recognizes that Small Scale Mining Operations, Operators and Motorized Equipment under 8" Nozzle size and under 40 HP used in association with mineral extraction and following Small Scale Operations defined in SMALL SCALE MINER MANDATE (1-4) upon waters of the State of Oregon are fully exempt from Clean Water Act permits due to deminimus impact and no cummulative effects as established in peer reviewed scientific studies.

*additional notes - 90 percent of the Miners using the outdoors today are family based, current proposed permits will take these honest law abiding parents, children, enthusiasts and deem them Felons for using their rights to prospect as written under Federal Law.

Environmental studies have consistently shown no harmful long term impacts, and yet we would place a felony conviction lasting a lifetime upon a person excersing their rights?.
