After being unable to reach my son by telephone I searched the internet to find my ex wife. She’d moved to Pennsylvania and placed my son into a residential treatment facility Hoffman Homes in Gettysburgh , PA , without my knowledge. She refused to provide me any further information. I contacted the facility and spoke to a case worker Ms. Barnes and set up a visit. She informed me my son was being medicated with Risperidal. I checked the drug on the internet to find out what it was for and what the side effects might be for an 8 year old. To my surprise the drug hadn’t been approved for children and cause sterility. When I got there I saw he didn’t look well. His face was swollen and he had a lost look on his face. He was glad to see me. The counselors gave me a tour to assure me my son was in good care. They were also very vague as to why he was there. I asked them why they would have my son taking a drug that isn’t approved for children and causes sterility. They told me my son had been diagnosed Bipolar and ADHD. I filed for custody immediately. I received custody of my son March 11, 2005. On April 12 2005, due to an incident at school caused a CPS investigation. Case worker Nina Nelson/WCDSS came to my home with blank disclosure forms for me to sign. I refused. She advised me to have my son evaluated at Mt. Vernon Hospital . I cooperated being I wanted to help my son get the care he needed. At the hospital while I was registering my son Ms. Nelson was speaking with a nurse, the same nurse checked my son’s vitals. We were escorted to a small room in the back. After almost three hours my fiancé went to get us all dinner. We ate and waited a few more hours. I asked Dr. Bartow (the one who blew himself up) if he knew how it would be before my son could be evaluated. He told me “We have a bed for him” I asked him how could he have a bed for him without an evaluation? He called the police on me. The police that were sent were threatening and used vulgar language. My fiancé called 911 to request a sergeant come to the hospital. She called three times and was told “The police are already there.” Finally a Dr. E. Walsh came and evaluated my son. He rectified the whole situation and sent us home. This traumatic event was not over. I received a call from Susan Berger and Terry Richard both of CPS. They requested that I apply for welfare to get “services” for my son. I asked them about the legalities on page 14 of the Welfare intake form which is needed to apply for services. They were unable to answer my questions. I went to DSS to ask them about the application. They called the police on me and had me BANNED from the building by Iris Jenkins/Associate Commissioner of Social Services. In September 2006 I was charged by CPS with medical neglect because I hadn’t applied for Welfare. On October 5, 2006 in front Judge Cooney I was offered to sign a voluntary placement form in order to have the medical neglect charges dropped and my son would not have to take medication. I agreed to a 48 placement at Four Winds. My visits were denied. I was called for a meeting 10/29/05. Two pieces of paper were thrown across the table by Terry Richardson/WCDSS who told me “You are indicated for medical neglect. After four months of denied visits, my son was transferred to Pleasantville Cottage, Pleasantville , NY . I was denied visits for another two months. In the past three years I’ve gone to: Legal Aide, they told me I have to be on Welfare Student Advocacy....unable to help. I am charged with neglect by Family Court from an incident where my step-son and one of his buddies were playing with fire in the house. CPS says I did nothing about it but that is a lie. I took away anything my step-son could use to start fires with and he was watched very closely in the house. Also, I said something in front of my 8year old daughter that was thinking out loud and was not how they took it. I said that I'd be better off dead than to have to put up with the crap that I was getting. This was related to the extreem stress that I was under at the time. Both children have been in a "safety plan" since late December of 208 and now we are being told that they can't remain in that plan any longer and they want those people who have the kids under this plan to file for custody. I get the feeling that they have no intention of ever letting the kids come home. Also, they say that I am not capable of taking care of my daughter because of health problems. I am a disabled veteran and, yes, I have some problems but none that would prevent me from taking care of my child. I am super upset over all of this. My children are in worse shape now 10 full months later then at my hardest times ever in my 17 year single mother history! I had never been arrested in my life untill that night. Her mother, Nicole had delt with C.P.S. in the past, and had her other daughter Jordyn, age 2, stolen by them. That was Abbys sister. Now Nicole is a good person. Shes not perfect. She has made mistakes. Most of them, after they stole Jordyn. Before all this happend, Nicole lived life right and Jordyn had a pretty happy life with her mom. Right before they stole her, Nicoles older brother Jim, died at the age of 25. Being a single mom, Jim helped Nicole and was a very large part of Jordyns upbrining. Before Nicole could even start moorning her brothers death, CPS came looking for someone else at Nicoles Apt.that she shared with her mom(Nicole wasn't even the target of there investagation).Trying to save face,CPS then ASKED them for drug tests. Nicole and her mom, feeling that CPS had no right to ask,declined, protecting their rights. One month later, while Nicole was sleeping,CPS stole Jordyn, right out of her bed. As of Jan 2009, Jordyn has been adopted. Jordyn will never see her mom or grandmother, or ever meet her sister. Nicole firmly believed she was taken advantage of and they used her misery to steal her daughter." It feels like another person that she loved dearly, died." Nicole then started to drink and use drugs to ease the pain. What came out of this? A broken mother, family and a lost little girl. My name is Russell III. I have a son, Russ VI, age 10. I havent been with Russ's mom for 9 years, but we share the responsabiltys. I love my son with all my heart! I met Nicole in June 2006. At first, on the outside, Nicole looked like any beautiful, young 23yr old. But as time went by, you could hear and feel the pain she was carrying. She could'nt even look at a picture Jordyn with out crying. since I've been with her, shes gotten better. We had Abagail in Aug 24, 2008. Because of her past with CPS about Jordyn, they were able to take Abby On the Aug 26., violating my rights of a father. I've given 6 mths of clean drug and alcohol tests, and recently joined the New York State National Guard to better my life, and they still want me to go into a drug and alcohol program, which I cant afford or get to. On March 25, 2009 a placement hearing took place in Dutchess County, N.Y. Now they get to keep Abby for another 6 mths and let her be put up for adoption cause I could'nt complete my programs. I have worked hard to stay sober for 16 years. I got my children back in 1995. I went to a fair hearing to expunge my record, and they said there is nothing they can do because of the stature of limitations. They said the only thing I can do is talk to my employer. I understand that I went for a 424A and I should have been going for a 422, but again it is too late. They punish the people that do well, and take care of their children, and do nothing to the ones that need to be watched. Oswego Co. is known for messing up. Recently an eleven year old girl was killed because of ther negligence. IT IS SO SAD. THank you, I really don't know where to go with this. Other than never apply for a job where children are involved. I work with Mom's to help them get into treatment for alcohol, and drug alligations, so their children aren't taken. The CPS worker said that the case will be founded due to there were criminal charges, and I should get my tubes tied because I will be having my 5th child by the 4th guy(my second HUSBAND!). I was allowed to keep my children as long as I agreed to work with a SPIFY worker to get into anger management counciling. I am 7 months pregnant and after more than 60 days the CPS worker said she'd be closing the case out due to I had fully complied with her refferal to a spify worker to voluntarily enroll myself in anger management counciling. Within a week she called me back telling me that her supervisor had just advised her to file a neglect petition on me to have ALL of my children removed from my custody(including my unborn daughter, who I plan to breastfeed when shes born in June)for the initial, and only incident ever, and that she wanted me get a psychiatric evaluation. I was told that as long as the evaluation came back normal she didn't see why she wouldn't be able to close the case out, BUT she didn't know what her supervisor would want to do.( I tape recorded the entire conversation!) I am comfortable with getting a psychiatric evaluation, in fact I have already scheduled one on my own. Now the case has passed the 90 period. I took my children to the park today 3/20/09 and when I returned I foung a letter from the CPS worker telling me I had to sign a form immediately to continue services. I don't feel comfortable signing this form, they should have done their job in the 90 days given for the investigation. They can call and confirm the appointment with the psychiatrist due to I provided CPS with a form stating they were allowed to access this information for 12 months past the date of me signing. My children are A students, are and have always been well taken care of and provided for. They have never been subjected to abuse or neglect in any way shape or form. The 2 boys share a room and the 2 girls share a room, in which they all have their own beds, there is always a more than adequate supply of food in the house, it is clean, they are bathed, have tons of clothes, shoes, jacket, all of the medical care required, and they even get their teeth cleaned regularly by the dentist. I will never say that my actions were not wrong because they very well could have become dangerous, but my children do not deserve to be removed when they weren't effected in anyway, and I am going to counciling to help myself with this issue. I think it's rediculous how this system is being run. They are trying to take kids out of good homes where they are well taken care of, thriving, and loved and placing them in state care. Yet they choose to leave young children in unsanitary homes where they are being neglected, and sexually molested, then murdered. The school did not ask for an explanation prior to reporting even though a parent was present in the classroom and spoke with the teacher prior to the report. We did not think we needed to proactively explain the scratch in order to prevent being taken to the police station. | The case has been closed as unfounded. We are preparing a petition to expunge. | Our constitutional rights have been violated repeatedly throughout this process. At this point, our right to privacy is being violated by keeping a record of a case where we were affirmed INNOCENT in the State Central Register. | We were never informed of our rights throughout this process. My children were taken from their school to a police station, questioned without representation, required to be examined by a physician (who by the way said this injury did not qualify for reporting) and had our home invaded. Now we have a record hanging over our heads for the majority of the rest of our lives unless someone agrees to expunge it and WE ARE COMPLETELY INNOCENT of any wrongdoing. The police officer assigned to the case immediately dismissed it and provided us a letter of support. The case worker also said he believed the injury was accidental, but was required to investigate and keep the case open for 60 days. We were never informed of our rights to not cooperate with the case. We were told we had to. | YES. I married a man in the military which is why we moved. From the minute my children and I arrived my ex-husband was very physically abusive towards me. I was isolated, and some how I talked him into letting me get a job. This man was so patient with my children that I trusted him not to hurt them. I noticed one day my children had bruises on their bottoms. I confronted him about this and after he beat the hell out of me he apologized and said it would never happen again. On July 19, 2008, my manager had asked me to work a double shift, i said yes but would have to go home first. I made my babies lunch, took a nap, woke up, gave my childrens a snack, and left for work at 3:45. At or around 7:15 my neighbor calls me and says my daughter is going to the hospital. She had a subderal hematoma and she was transported to SUNY hospital, in which she was diagnosed with shaking baby syndrome. My children were taken from me and my ex-husband for I could not give them an reason besides when she fell for her head trauma, and my ex-husband was the only one home and he wouldnt talk. At first I couldnt believe it and I denied any abuse. My mother came out and that is when I confronted him in which he admitted to shaking her because she wasnt breathing. I immediately got an order of protection, notified CPS and the acting Investigator. CPS told me that if I didnt sign this paper that i would never see my children again. I come to find out that the paper was for me to voluntarily let them take my babies. There has been no criminal charges brought upon myself, there has been criminal charges brought upon my ex-husband. And to this day my children are still in foster care. My parents have been approved for relative placement after an ICPC was conducted and for some reason my children have not gone. The father of my boys has petitioned for custody. CPS is entertaining his petition, and he is court order by Nevada courts, where I am from, to have supervised visitation. He is a dead beat father and only wants the children for child support. He has already filed for child support in Nevada. I have done everything CPS has asked and beyond, and nothing seems to move foward. I have visitation with my children 3 days a week in the foster home. I am battling the military as well for funds. I have no transportation. I have applied for jobs but with my sparatic scheduel it seems impossible. I have no funds, and my babies want to come home. I did not abuse my children. I will take blame for not leaving my ex-huband and for that it has caused my babies to suffer. I just am at a loss. I have no one to turn to. My support system is 3000 miles away and everytime i see my babies I have to explain to them why mommy cant take them with me. Please help me I dont know where to turn to. | Most definitly | |

In January 2007 CPS services became involved in Tennessee because my husband was hitting me off and on (DV case). In front of the kids because I had affair and I did want to leave him. I ended up sending my kids to NY state. My husband and I stayed here in TN for 3 months. I returned to NY in April 07. Immediatedly when I came home I was asked to work with a caseworker for Preventive services. It was said it was volenteer and I didn't have to do it. I decieded to work with them so I could not lose my kids. They were concerned about domestic violence that was occuring in front of the kids. My husband was on drugs(POT) and drinking alot. I wanted to work on things and had used all there services. My husband continued to hit me and fight in front of the children. My caseworker Melonie Lugo, said I needed to tell her when any abuse or drugs, were involved. She suggested I get a drug and alchol evalution along with mental eval. I didn't disagree. They didnt make him leave or suggest order of protect. He told them because I had affair and I ask for the hits. Hitting went on for years and my husband let my 12 yr old drink and use drugs which was documented. One of my family members falsely reported me and then some supervisor reported our case to the family courts. Now we are being charged with neglect on our four children. I have been working with CPS since April 07 and trying to be compliant. My son whose 12 missed 9 days of school and I had a Docters note but it wasn't good enough and his teacher saw him on a weekend at the mall and he didn't come in that following Monday. School reported it and then it went from there with court. They seem to also be playing my husband against me now he is safe and I am neglectful. I did leave the state not because of CPS but the abuse from my husband which no cares now to look at. They might take custody from me and give it to him. They court order my kids to stay in NY state til said otherwise. | YES |
