A call was made to the D.A.'s office and the case is still open. However,  Robert See is definately still getting prosecuted on animal cruelty charges.  Luisa asked what degree; and unfortunatley it will only be a misdemeanor charge.
So Please continue to sign, email, anything to urge a more fitted punishment for this horrible crime. I am pleased to know that See will at least be unable to become a guard in a prison.

Update:

A glowing report from the Dutchess County Department of Probation has
the District Attorney's Office rethinking its prosecution of a Milan
man accused of killing and beheading his pet cat.

At the same time, though, suspect Robert See, 30, of Indian Road, faces
a new charge of harassment, stemming from a dispute over a boundary
line with an unidentified neighbor.

See was charged in January with animal cruelty for killing a cat by
gunshot, and with discharging a firearm within 500 feet of a dwelling,
both misdemeanors.

The District Attorney's Office had planned to offer See a deal that called for him to plead guilty to a misdemeanor.

But in Milan Town Court on Thursday, Assistant District Attorney Frank Chase said the original plea may no longer stand.

"Our original offer was to a misdemeanor," Chase told Town Justice
Francis Christensen. "In light of this report, I don't know. This is
certainly a report that reflects very well for him."

Chase said probation officials found See, who hopes to become a
corrections officer, to be "candid, well-grounded and responsible."

According to the report, See believed his actions to be "a reflection
of the values in a rural area rather than reckless and wanton
behavior," Chase said.

The report also said See "didn't think his actions would upset people so much."

See was arrested on Jan. 11 by a humane officer with the Dutchess County Society for the Prevention of Cruelty to Animals.

Authorities said See shot the cat with a high-powered rifle after the
cat urinated on the carpet of See's home. He then chopped off the cat's
head with an ax, placed the head in a bag, and hung the bag from a tree
on a neighboring property. Authorities said See collects animal skulls
and intended to add the cat's skull to his collection.

A neighboring land owner discovered the cat head in the bag and notified authorities.

The case involving the cat was adjourned until July 6.

Chase said that although the District Attorney's Office doesn't
generally handle the prosecution of violations, he will retain
jurisdiction of the harassment case because there already is an open
case against See.

Politically-Motivated Probation Report Paints Rosy Portrait of Killer
In January, Robert See of Dutchess County in upstate New York shot his cat with a high-powered rifle after the animal urinated on his carpet. See then cut the cat's head off with an axe and put it in a bag which he hung on a neighbor's property. While he was arrested and charged with animal cruelty after the cat's decapitated head was discovered, it seems now that this cat killer may not have to pay for his murderous crime.

The District Attorney's office had originally planned to charge See with only a misdemeanor, but now they are leaning towards not prosecuting him at all. The reason is that See wants to be a prison guard, and having any criminal record at all would legally prevent him from being hired for the job. The Dutchess County Department of Probation seems more than happy to help him out by issuing a report characterizing See as "well-grounded and responsible" and his actions as "a reflection of the values in a rural area."

Such a statement by an official agency is an offense to the majority of people in rural areas who care about animals and would be horrified by the thought of someone killing and beheading their cat for urinating on a rug. Such a violent act against an innocent animal is completely inappropriate for anyone, and should certainly not be tolerated in someone whose ambition is to guard prisoners. Considering what See did to his defenseless cat, it is frightening to think of how he would treat incarcerated human beings.

Contact Dutchess County District Attorney William V. Grady and politely urge him to prosecute Robert See to the fullest extent of the law. Remind him that studies by the F.B.I. and U.S. Department of Justice have proven the connection between animal abuse and violence against humans, and that See's act of animal cruelty should automatically disqualify him from serving as a prison guard.
