I was denied the Rights of a U.S. citizen! I served 17 years of "illegal custody in America!!! I demand JUSTICE now.

In 1999, I was sentence to 292 months of Federal Prison; Without the Entry of a Plea of Guilty or an Actual Trial. Because I could not produce names of drug dealears dealing drugs crossing state lines. I never filed a Direct Appeal because I was never legally prosecuted.

In had just previously served 5 years probation, from June 29, 1992 till June 29, 1997, for possession of a controlled substance. I was discharged "DEFERRED ADJUDICATION."

**In July 2000, I contacted the Department of Justice and reported to them, the evils and civil rights violations that were committed against myself. On July 24, 2000, I received a reply from the DOJ stating that I had provided “no” specific evidence to warrant an investigation ---- Margaret A. Grove, Deputy Chief of Policy, Narcotic and Dangerous Drugs Section.

In 2009, while trying to get relief on President Obama’s, “The Fair Sentencing Act of 2010”, which reduced sentence disparity between offenses of crack and powder cocaine from 100:1 to 18:1; two female attorneys , again violated my civil rights and prevented me from getting relief by filing an Appeal on my behalf at the Appellate Court, the 5th Circuit Court of Appeal ***with No Original Files for my case. While I was waiting on a decision from the U.S. District Court to give me permission to file the Appeal, Pro Se. I called the 2 of them and asked them why did they file an Appeal on my behalf without my permission and without my knowledge. They claimed to not have been the ones to file the Appeal. “Of course I was denied”

Today, according to the U.S. District Court in Lufkin, Texas: the Federal Record Center can not locate the box the Original Files are located in. (08/05/2009, #146 Criminal Docket Sheet.) Therefore, I was never afforded Redress. Even though the Government fought me all the way to the Supreme Court. ****With No Original Files Record. No Transcripts.

***It all began when a U.S. Atttorney and a Department of Public safety Narcatic Agent, paid me a visit at my home one evening in April of 1999. They asked to speak with my son and myself. They told me that they "knew" that I knew some big drug dealers dealing drug crossing state lines. They threatened me and my son with "sealed indictments," which would net long prison sentences if I didn't come up with some names for them. I told them that I had no names for them. The DPS Agent told me to call him back at his office, which I did that same evening. When he told me to come to his office the next day, I told him I would only come with my attorney. He angrily told me "just forget it! We'll get with you later."

About 2 weeks later, early in the mornig, an FBI Agent and 2 Lufkin Police Officers came banging on my door claiming to have had a warrant for my arrest. After searching my house, I was told to step outside to be publicly arrested.

During the 4 days of incarceration an attorney contacted my sister claiming to have information regarding the case. He told her that he had just sspoken with the Attorney General, and that if she hired him to represent me, he would get everything taken care of quickly. Of course he was hired.

His call was staged. In fact he was sent by the Government to be my Public Defender. He was later paid the full amout of my widow's pension check, $7,500.00.

But his greed for money outweighed his loyalty to the Government. He confessed to me that the Government had sent him to me to get names of drug dealers dealing drugs crossing statelines. They thought that I would make a good witness for the prosecution. He said I never should have been arrested in the first place.

There are no "ORIGINAL RECORDS" for my case. The Federal Record Center cannot locate the box they are in????PLEASE SIGN THIS PETITION, THIS SHOULD NOT HAPPEN THE U.S.A.. The prosecutors need to be held accountable for their crimes.
