Urge The Senate to Reject William Myers' Nomination to the Federal Bench

America's wild and beautiful west might not be so wild or beautiful if President Bush gets his way. That’s because Bush is waging an increasingly aggressive campaign to stack the federal courts with anti-environment judges.

Thanks to a Senate compromise, the filibuster has been preserved for the controversial nomination of former mining industry lobbyist William Myers III to a lifetime appointment to the Ninth Circuit Court. The Ninth Circuit decides legal disputes over the use and conservation of some of the most wild and sacred areas in the United States, including Alaska, Arizona, California, Hawaii, Idaho, Montana, Nevada, New Mexico, Oregon and Washington.

Given Myers extreme anti-environment views -- he's called parts of the Clean Water Act an "unauthorized federal regulation of land use," and, as the top lawyer at Bush's Interior Department, consistently sided with oil industry lobbyists and other major corporate polluters -- it was is a great step forward for our environment and for our democracy.

The Senate compromise demonstrates the power of citizen participation. But while the compromise is a great step forward, now we have to stop the Myers nomination.

Urge your Senators to reject a lifetime appointment for Myers! If he's confirmed, he's likely to be undermining environmental laws for decades to come!

I am writing to strongly urge you to oppose the confirmation of William Myers III to a lifetime federal judgeship on the Ninth Circuit Court of Appeals. Mr. Myers's attacks on environmental safeguards, including his actions as the Interior Department's Solicitor, demonstrate his inability to serve as an impartial jurist in cases involving natural resources or public health. His professional credentials consist primarily of his service as an advocate for mining, grazing and other special interests opposed to federal environmental laws that are critically important. His lack of sufficient legal credentials caused the American Bar Association to give Mr. Myers its lowest passing grade for a nominee.


Mr. Myers denounced the California Desert Protection Act -- a law that passed during the 103rd Congress with overwhelming bipartisan support -- as "an example of legislative hubris." He argued to the U.S. Supreme Court that Congress lacks the authority under the U.S. Constitution to extend Clean Water Act protections to certain wetlands and other waters -- a position that is even at odds with the Bush Administration's own Department of Justice. His call to elevate property rights to the level of "a fundamental right" under the Constitution would result in striking down many of our nation's important environmental laws as well as many other health and safety regulations.
As Solicitor for the Department of Interior, Myers's key decisions were rebuked and overturned by the Federal bench and his own Department of Interior.


Mr. Myers's extreme anti-environment positions make him an unfit candidate for the federal bench, especially as a Court of Appeals judge for the Circuit Court whose jurisdiction contains more National Parks, National Forests than any other federal public lands than any other circuit.


I urge you to oppose the confirmation of William Myers to the federal bench and to oppose any effort to invoke cloture to end debate on this judicial nominee.
