Demand full compensation for damages the State of Michigan, the Michigan Probate Court, and Ferris State university caused me
In October of 2013, while in an ongoing class, two Grand Rapids, Michigan, Police officers can to my class and arrested me.
All I was told is that a Probate Court judge has issued an order for my arrest from class because someone in my university had petitioned me for a psychiatric evaluation.
I had no prior psychiatric history, no prior notice from the court or my university of the petition. I thought the 14th Amendment to the United States Constitution requires I be at least giving a notice before being"crucified?" Actually, I had never even met with the petitioner.
The officers took me to a State own preadmission facility and tried to force me into a psychiatric evaluation. Since at that point I did not even know what was going on, I requested for an attorney before talking to anyone. Because I was never granted an attorney, I stayed quiet the entire two hours I was confined in a room.
Notwithstanding and shockingly, the officers transported me that same day in to a psychiatric facility where I was detained for 16days involuntarily. Important to note that I had not done anything wrong. But, the 4th Amendment to the United States Constitution protects me from arbitrary seizure.
I went back to school to complete my semester after I was released from the involuntary confinement, but my university told me I had been dismissed from my program of studies for medical reasons. Notwithstanding, I had no medical condition which prevented me from attending school. So, I went through the university's hierarchy to be reinstated, but the university denied letting me in back.
Thus, I filed a civil rights complaint against the university with the United States department of education's office for civil rights (OCR). After three long years of investigation, under severe persecution, the OCR determined the University breached my rights. The University agreed and endorsed the determinations. The OCR also provided me with a letter of finding and with a right to sue the university for the damages they caused me since I was never rei stated to finish my degree. I thought this was a fair thing to have done.
At that point, I had lost 6 years of school and owed $200,000 of government backed student loan. I had lost everything I worked for as a result of the same spiteful treatment I was subjected to. I had also been rendered a destitute, homeless, and suffered all kinds of humiliation.
In September of 2016, with the help of an attorney, I brought a Federal lawsuit against the university. The Federal court is in Grand Rapids Michigan, the same small city where the discrimination had first occurred. In fact, almost everyone is related in that city.
The Federal judge, also from that city, ruled independently, denying my rights to a jury trial, 7th Amendment rights, contrary to the government finding that my rights where not violated.
In fact, the judge stated amongst other things, in correctly, in court records that the Probate Court, the same court that had ordered my arrest without giving me a notice, had ordered me 90days of hospitalization after I was arrested from class. This had never happened. At least there would be hospital records to match the 90 days hospitalization or records on how the court had discharged me. In fact, the judge also stated,inaccurately and contrary to the OCR finding, that the university had implemented university policy to dismiss me from school. Actually, the only document the university handed me before dismissing me from school, does not reflect that University policies were considered.
I demand the United States Congress to open a full investigation on these issues I have raced, and remand that I be compensated fully for the damages this spiteful and arbitrary treatment by the State of Michigan and my university caused me as the law demands. My life has been completely ruined.
