If they are off from school or sick on Fridays or Mondays I take time off from work to be with them. When I got divorced last year I did not realize that NYS does not recognize shared physical custody and that equal joint legal custody does not mean the same thing (did a pro sea divorce). My ex-dragged me into family court last Spring after moving out of the house, claiming I was not paying child support, which I thought I was since our children live with me about 3/7th's of the week and I was paying for all their school lunches, daycare and medical expences. I also took a job over a year ago that paid significantly less than my previous one to try something new in my career and free up more of my time to be with my family. The court system turned a deaf ear to the whole case and treated me like a dead beat dad. My ex can easily earn 2x more than my current hourly salery with very little effort but chooses not too. Instead the court ordered me to pay child support based upon the salary of a job I left over a year ago claiming I am capable of earning that much and as if I only saw my children a few times a month versus them living with me almost half of the week. In reality I see my children more than my ex during the week because they are in school/daycare most of time she has them. The court order decision was made the way it was because of outdated NYS laws. I earned more than her on the 2005 W2's and she has the kids more 'nights' than me. Those were the only details the court seemed to care about when making the judgement. Why does child support in my sitation have to be determined by how much I earned in the past versus now and not the percentage of time I spend caring for my kids every week. 57% of may wages are being garished now by NYS and I still have to feed/cloth my kids, pay a mortgage and maintain their household on what's left over on top of all the other stuff listed in the order that there literally is no more money left over for. Why couldn't the court order my ex to earn more money the way I was? I can't afford to pay a lawyer anymore than I already have and fight this order/get the ammount reduced (I was told by my lawyer 99.9% of the time they agree with the magestrates orders so I didn't want to waste any more time or money I need to care for the kids on fighting a lost cause). I feel like the only choice I have really been given is to find another job that pays enough to cover what the order says I have to pay. It took me several years to find the job I left the old one for so it very well may take that long to find another one that pays better...also who wants to hire an older part-time employee who can't work weekends...I'm not as flexable with my time as someone younger...I also may be forced by this order over time to give up the current custody arrangement because NYS does not care that I am sharing parenting responsiblities with my ex more than the traditional divorced father. They also don't care if I have to go bankrupt to take care of my kids. They only want the money. I want to be my kids father, not supplemental income for my ex-wife. Lawmakers and politicans say they care about the welfare of children claiming that is why these laws are in place in reality they only care about how much money they collect and that they get matching federal dollars for the money they collect through garnishments...Is this just or fair? |

If you want to see your children it costs an extra $125/hr with a 4-8 hour limit per month. Theo Bedard and M. Lewis are the epitomy of what is wrong with family courts. They rape the fathers and allow the mothers to do anything. This is how family court gets even with men. In this court, if you have a vagina you win. Period. I lost six children, every material good, every penny, and have not seen four of my children in 7 years. Who wants to bet their evil mother hasn't screwed up their lives? |

SHARED PARENTING IN NEW YORK
A child loves and needs both parents BEFORE a divorce
-- they continue to do so AFTER a divorce. Shared
parenting assures children whose parents divorce EQUAL
access to BOTH parents, providing both parents are
"fit."
Allowing a child to see one of their parents, on
average, four days a month is incredibly cruel. And,
it hurts our society as well. Statistics have shown
us that children who are deprived of their fathers are
at a much increased risk for child abuse, suicide,
drug and alcohol abuse, school delinquency, behavioral
and emotional problems, criminal behavior, and teen
pregnancy.
Shared parenting can help to prevent these problems by
keeping fathers IN their children's lives. We need to
do all we can to protect our children; we need shared
parenting made into law THIS YEAR -- before one more
child suffers at the hands of this barbaric system.
These problems also affect society, both socially and
economically. Think about how much money is spent in
dealing with these social issues each year. Money
that could be put to much better use elsewhere!
The current system does nothing more than encourage
animosity between divorcing parents. Children are not
property, to be fought over in court. They are human
beings, deserving of respect. It is not fair to treat
children in the manner which the current system treats
them.
