Frank Aquino, 43, of Putnam County, is accused of viciously kicking his neighbor's elderly dog to death. Neighbors witnessed Roxi wander onto Aquino's property during a holiday cookout over memorial weekend.

Aquino has pleaded not guilty.

The court case has been adjourned again.

"
Frank Aquino was due in Putnam Valley Town Court at 9:30 a.m. to answer
felony charges of animal cruelty, but the case was adjourned for a
second time. Neighbors have said they saw the 40-year-old kick the dog
like a football, and that the 45-pound mixed shepherd dog dragged
herself under a tree and died.

The incident took place May 30 during a Memorial Day barbecue at
Aquino's home. He was arrested June 5 after two guests at the party
realized the dog had belonged to Lisa and Bill Sampson, who live across
the street from Aquino. He was arraigned in Town Court June 9 and
released on bail.

Court officials said the case was adjourned because Aquino
said he was ill.
