On November 16, Phanord pleaded guilty to the top count of aggravated cruelty to animals, according to Spota, and is facing the maximum penalty.
In the meantime, members of the New York State Assembly have proposed legislation to expand the penalties for animal violence. Though the bill still is pending, it seeks to increase charges for those who commit aggravated cruelty to animals from a class E felony - which has a maximum prison sentence of two years - to a class D felony - which has a maximum prison sentence of seven years. Efforts to increase animal cruelty penalties are being pursued on the town and county level as well.
Phanord is scheduled to again appear in court on January 17, 2008, according to Spota, when he will be sentenced to two years in jail.

Phanord was arraigned Tuesday on a grand jury indictment that included felony animal cruelty charges. He pleaded not guilty to two felony counts of aggravated cruelty to animals, two misdemeanor counts of cruelty to animals, as well as weapons possession and traffic charges.
This sicko ADMITS what he did, yet pleads NOT GUILTY?!

Derick Phanord, 22, of 156 Cocoanut St. in Brentwood, was arrested at 11:30 p.m. Monday after the Suffolk police got a tip that he was the dog's killer, police Commissioner Richard Dormer said
In his own words!
"After tying Spike to a tree, "I poured the gasoline ... on to the dog. Then I said a prayer for the dog, made the sign of the crucifix," Phanord said, "I took the cigarette I was smoking and lit the gas that puddled on the ground. The gas caught on fire and the dog also caught on fire. I turned my back and walked away."

"Maximus," a 2 year old pit mix that suffered severe burns after someone chained him to a tree, doused him with gasoline, and set him on fire in Brentwood, has died.
The badly burned animal was found by a resident and taken immediately to the Veterinary Medical Center of Long Island for emergency care last week, but he died on Tuesday morning.
Maximus suffered burns to more than 60 percent of his body, leaving his skin raw and his outlook grim. Maximus succumbed to his injuries after midnight at the Veterinary Medical Center in West Islip.
Rescue workers were horrified by how the animal had been abused.
"We cannot allow such horrific crimes be committed against our companion animals," said Veterinarian Dori Scofield, director of Save-A-Pet.

First we want to thank all of you who participated in the rescue and care for Maximus, and our hearts ache along with yours for the loss of this sweet soul.
Fight for Maximus just as Operation Kindness of TX fought for Mercy who's life was tragically taken in the same manner. The world was outraged, then, and should be again.
Levy plans to lobby the state Legislature for an amendment to Buster's Law, which now provides a maximum penalty of two years in prison for aggravated cruelty to animals. Levy wants to increase potential penalty to a five-year maximum prison term.
Levy also wants to establish a permanent reward fund aimed at encouraging confidential animal cruelty tips to the Crime Stoppers hotline. And he wants detective squads to work more closely with the SPCA.
We support these efforts and stand behind Levy. We believe 2 years imprisonment (if he is sentenced) is not enough for what Derick Phanord did to this innocent animal, but it will be better than putting him back on the streets. With the combined charges against Phanord, we hope for a much stiffer penalty!
