Protect the Rights of Medical Malpractice Victims

Each year, over 100,000 people are killed by preventable medical errors, due to negligence or wrongdoing. Many more are seriously or permanently injured, disfigured or disabled.

The leadership in the House of Representatives is promoting legislation, written by the insurance industry and HMOs, which would restrict the ability of Americans injured by medical malpractice to hold accountable those who caused them harm.

The legislation would create a "one size fits all" system for people injured in a medical setting or nursing home. The limits would apply no matter how severe the harm - even if the wrong limb was amputated, an unnecessary mastectomy was performed, or even in cases involving the death of a child.

Congress has their priorities mixed up. Shouldn't we be talking about protecting the health and safety of patients, rather than protecting Congress' corporate friends in the health care, insurance and HMO industries.

Urge Congress to oppose any legislation seeking to restrict the rights of people through so-called medical malpractice "reform."

Dear Representative,

We, the undersigned, petition the United States Congress to protect the rights of the victims of medical malpractice rather than the profits of insurance companies, the health care industry and corporate CEOs.

Casualties continue to mount in Iraq, the federal debt is soaring and gas prices have topped $3 a gallon in many parts of the country. We urge Congress to focus on these important issues facing our country, rather than catering to corporate special interests.

The leadership in the House of Representatives is promoting legislation, written by the insurance industry and HMOs, which would restrict the ability of Americans injured by medical malpractice to hold accountable those who caused them harm.

The legislation would create a "one size fits all" system for people injured in a medical setting or nursing home. This legislation would allow the Congress in Washington DC, rather than a jury of twelve citizens, to decide the value of an injury or death caused by malpractice.

The limits would apply no matter how severe the harm - even if the wrong limb was amputated, for example, or an unnecessary mastectomy performed, even in cases involving the death of a child.

For patients who are injured or the family members of those who have died as a result of medical malpractice or negligence, the civil justice system is the last resort and the courtroom is the only place where they can seek justice against powerful interests on a level playing field.

We oppose this "one size fits all approach" and strongly urge our Members of Congress to adamantly oppose any legislation seeking to restrict the rights of people through so-called medical malpractice "reform."

Medical issues are of vital importance to the wellbeing of any society. The ancient Incans had doctors carry the victims of medical malpractice on their backs for life or until the corpse would rot as a reminder of their mistake. If they need to be payed more to deal with medical malpractice law suits, so be it, but they should not be allowed to make a mistake on a human life.

Patients must retain full rights to litigate in malpractice circumstances. In the knowledge that they can be taken to court, doctors will be less likely to make medical errors. Patient's rights intact, will help prevent medical negligence.

My grandma spent 6 months in the hospital and almost died multiple times after her doctors ignored a staff infection from her outpatient by-pass surgery. It seemed like the entire hospital tried to cover for each other. Those 6 months were hell on my family, and we didn't even try to sue. Victims need rights.

Patients are the ones who need protection, not the Insurance Companies and HMOs. HMOs were the worst idea to hit in the late 20th century. Idiotic grand management, cookie cutter, production line style rules DON'T WORK HERE!! The victims need recourse when wronged by doctors and insurance companies. And malpractice happens all too often.

A victim of medical malpractice should be protected not the insurance companies and HMOs. If you went to the hospital and they gave you an unnecessary procedure that left you unable to walk or talk normally or left you disfigured in some way, you'd want to take action to make sure those responsible pay for their negligence. If you pass laws AGAINST the victims, you'll be in the same boat as the rest of us. Please protect the victims and not the greedy companies!!

The Medical Industry, along with Medical Insurance are sucking the American people dry. It's basically a racket which government needs to step in and control the costs of quality care. I asked my own doctor what it would cost for a regular doctor visit if I didn't have insurance and then when I get my insurance summary, it's twice the amount that I was quoted. This is the same with all medical providers. It's no wonder our insurance costs are skyrocketing. Also, even though they might think so, doctors are not gods. They are human and subject to human error. I find most of the time their errors are due to their lack of referrals when they don't know what the hell they are dealing with. They make stupid and wrong diagnoses based on their lack of having specific tests done which is mostly due to the insurance not covering the tests. This is the 21st Century for God's sake, not the 19th or even the 20th Century. The resources are out there and the doctors I know don't even access them. How stupid and ignorant is that!!!!! It's a damn shame that the all mighty dollar determines the medical care and even life and death of a person. I know some people like to get something for nothing but what's happened to the Medical Professions Hippocratic oath??? What would you do or how would you feel if you know someone who was misdiagnosed and mistreated for diabetes when in actuality she pancreatic cancer. She died about a year ago. If that's not malpractice, I don't know what is!!!!! This kind of bulls_ _t happens all the time!!! YEA, I'D SAY VICTIM RIGHTS NEEDS TO BE PROTECTED!!!
