Date: Mar 13, 2008 9:31 AMSubject: NO JUSTICES FOR JASMIN GO AND POST COMMENT PLEASEBody: MOUNT HOLLY %u2014 A Trenton man pleaded guilty yesterday to endangering the welfare of a child in the death of an infant he was baby-sitting at a Mount Laurel motel in 2006.

David A. Fink, 22, was initially charged with murder and endangering the welfare of a child because investigators believed he shook the 5-week-old baby to death. As part of a plea agreement, the murder charge will be dismissed when Fink is sentenced in May.

Fink told Superior Court Judge James Morley that he was smoking marijuana and playing video games when his girlfriend's daughter, Jasmine Fink, fell off the bed in a room at the Econo Lodge on Fellowship Road.

The girl's mother, Dawn Zoglio, 24, sobbed as Fink entered his guilty plea.

%u201CThey didn't do any justice for my baby,%u201D she said after the hearing.

While the baby had Fink's name, he was not her biological father, officials have said.

Fink has been in Burlington County Jail in Mount Holly since his February 2006 arrest in the case. Prosecutors are recommending a sentence of time already served in the jail and two years' probation. They are also recommending that Fink cannot have contact with Zoglio.

Commenting on the sentence, Mary Zoglio, the grandmother of the baby, said, %u201CThere was a very big injustice done today in regard to the innocent life of a 5-week-old girl who didn't have a chance to defend herself. ... The man who took her life in malice is not going to get any more time for this.%u201D

Assistant Prosecutor Thaddeus Drummond said the murder charge was dropped after investigators reviewed all medical evidence, including records from the Philadelphia Medical Examiner's Office and Children's Hospital of Philadelphia as well as a neuropathologist's findings.


%u201CGiven the totality of the circumstances and the totality of the medical evidence, this is the appropriate disposition,%u201D Drummond said.

Zoglio said she left her daughter with Fink on Feb. 24, 2006, so she could do laundry. When she returned to the motel room, she and Fink decided to take the baby to Virtua Memorial Hospital Burlington County in Mount Holly because the infant was having seizures and difficulty breathing.

In court yesterday, Fink admitted he did not tell the hospital staff that the baby had fallen. He said the baby seemed fine after he picked her up off the floor and she stopped crying.

The baby died at Children's Hospital after being taken off life support on Feb. 27, 2006. The Philadelphia medical examiner ruled the death a homicide.

However, Fink's court-appointed attorney, Donald Ackerman, presented prosecutors with a report from a specialist who reviewed the child's medical records and found the infant died from an existing brain condition.

Fink also pleaded guilty yesterday to a burglary in July 2005, in Pemberton Township. He is expected to be sentenced to time served, probation and restitution. Morley is expected to sentence Fink in both cases May 16.

We need to get the DA to NOT drop the murder charge and raise the endangerment charge to at least 2nd degree,so we get some JUSTICE for the death of this beautyful baby girl whos life was taken in malices,she was only 5 weeks old,3 doctores said she died of shaken baby,and now the loop whole because they did not save a part of the brain,he is going to walk if we do not get public out cry to stop this so in saying THANK YOU FROM THE BOTTOM OF MY HEART PLEASE SIGN THIS AND PASS IT ON.GOD BLESS ALL
