On June 21, 1988 Wayne (Akbar) Pray was arrested and charged with violating several narcotic statues. Although Akbar had no previous record as it pertained to narcotic and no history of violence on his record whatsoever, Akbar was charged under a statue that was at that time the most draconian Federal Statue, absent the death penalty that existed under federal law.
The 848 Super Kingpin Statue which carries a mandatory sentence of Life without the Possibility of Parole had only been used three times since its enactment into law. It was under this statue that Akbar would be tried and ultimately found guilty. It bears noting here that Manuel Noriega, Carlos Lehder, not the infamous Ochoa brothers were tried under. Indeed, Manuel Noriega has since finished his federal time and has been released to the French Government on a separate matter.
Although this is not a forum to retry or relitigate Akbar's case, it is nonetheless important to note that, there was no physical evidence connecting Akbar to the alleged broad sweeping conspiracy that he is alleged to have headed. Additionally, and moreover, nor were there any wiretaps or direct or indirect sales of narcotics that is all too common in most narcotic cases.
Akbar was tried and convicted almost exclusively on the testimony of his alleged suppliers, both of whom have long since been released from custody. Now 22 years later and nearly 15 years as Akbar's alleged suppliers have been released, Akbar yet remains behind bars, 7,985 days later. There is something seriously wrong with this picture!
In the past many of us who have had the pleasure on knowing Akbar up close and personal, who have heard or witnessed his generosity of spirit and resources, have often shook our heads at this travesty, that some have dared to call justice. Well to those like myself and others now involved in this project, we say collectively and resoundingly, ENOUGH IS ENOUGH, TIME SERVED!
To these ends we are collecting signatures under the banner of FRIENDS OF AKBAR PRAY in the hopes that our collective voices gathered here online an in cities across the country, will when submitted to the United States Pardon Attorney, move the Obama administration to commute Akbar's sentence to time served!
