We the undersigned being residents and property owners in Apache County,AZ want to establish our legal nonconforming use status resulting from the Apache County officials failures to follow the state statutes when adopting enacting and amending the Apache County Zoning Ordinance. We ask that a investigation be done into nonfeasance of office by the Apache County Officials. We ask that our rights be protected and those who have violated those rights be charged with nonfeasance of office and removed for cause.
To the Apache County Officials, We the undersigned are asking you to do your job. And we are also asking that you do what your oath requires you to do. We ask that those public officials involved with the misuse of the Apache County Zoning Ordinances be charged with nonfeasance of office and removed. You all have taken a oath to follow the law and those of you who have failed to do that should be investigated. We the property owners that have signed this petition are claiming LEGAL NONCONFORMING USE STATUS. due to your failure to follow the required statutes when adopting the zoning ordinance and building codes. And any further actions on your part do hereby consitute a violation of your oath. You are on notice that we will stand together to stop your violation of our rights. As of Dec.2, 2008 when Article 13 was approved for amendment into the Apache County Zoning Ordinance anything built prior to that date is a legal nonconforming use. And this is based on the case law of Davis v Hidden and the fact you never had a legally written requirement for a building permit nor any legal ordinance to enforce the lack of a permit. You are the guilty parties and should be charged as such.
