ENCLAVE RESIDENTS FOR DISABLED ACCESS

    Our Enclave building is not friendly to disabled people. If you are disabled, how do you get into our building? And how do you get from the garage elevator lobby into the parking lot?
    If you are in a wheelchair or on another type of required mobility device, getting into our building, or into the parking area, by yourself is a daunting challenge. You will note that the front door swings outward. The steps you must take when using a mobility device includes:
    1. Using your FOB or keying a code into the box next to the sidewalk;
    2. Driving your wheelchair or other device up to the front door before the buzzer ends;
    3. Grabbing the door from your mobility device and opening it before it locks;
    4. Since the door opens out, you have to figure out how to keep holding the door handle
    while you back up;
    5. If you back up too far, you lose your grip on the door and have to start all over;
    6. If you timing is perfect, as you back up to pull the door opem, you then have to figure
    out how to move yourself forward while still holding the door.

    While it is true that legally an HOA is exempted from the federal ADA laws, the State of California requires that an HOA must offer a reasonable accomodation to the disabled.

    The Port Marluna (PM) HOA Board of Directors has refused that accomodation. The cost to provide that accomoadation on the side of the doors that open out is minimal. We the undersigned hereby Petition the PM Board to install Disability Entrance Push Button mechanisms to enable disabled residents and guests to open these two doors. We the undersigned are aware that there are a number of disabled residents affected by the PM Board's refusal. Further, we are aware that there are a significant number of seniors in our building who will need such access at some point in the near future.

    Resolved, therefore, that the undersigned hereby Petitions the PM Board to install disabled push buttons on these two doors to accomodate the disabled to enter our building and enter the garage.
