RESTORE VACCINE-INJURY LAWSUITS AGAINST VACCINE MAKERS

  • by: Illinois Parents
  • recipient: The Illinois General Assembly and Illinois Governor

In 1986, the U.S. Congress enacted the National Childhood Vaccine Injury Act, 42 U.S.C 300aa-10 to 43, which, among other things, created the "Vaccine Court" and the National Vaccine Injury Compensation Program. In "vaccine court", claims of injuries caused by vaccination are brought against the Secretary of the U.S. Department of Health and Human Services, NOT AGAINST VACCINE MAKERS. Furthermore, compensation for vaccine injury is paid out from a fund created by tax dollars, NOT VACCINE-MAKERS' PROFITS.

This petition is for citizens in Illinois.

Unlike other Illinois petitions on this subject, which are poorly worded, not well thought out, and present irrelevant facts, THIS PETITION IS VERY SIMPLE.

We, the citizens of Illinois, request that the Illinois General Assembly draft and pass, and the Governor sign, a RESOLUTION to urge the U.S. Congress to remove from law the provision that protects vaccine makers from civil lawsuit liability. Simply put, we want Illinois legislators to support the peoples' desire to be able to sue vaccine makers if they or their children are injured by vaccination. Resolutions geared at achieving the same purpose have been filed in at least three states: Washington, Minnesota, and Oregon. See links below.

Similarly, the Illinois Resolution should specifically urge the U.S. Congress to remove any law which protects vaccine makers from vaccine-injury lawsuits and/or to enact legislation which allows vaccine manufacturers to be held liable for design defects that result in adverse side effects or vaccine injury.

Example Language: "Your Memorialists respectfully pray that the United States Congress pass, and the President of the United States sign, legislation removing 42 U.S.C. Sec. 300aa-22(b)(1) from law and therefore allow design defect claims against vaccine manufacturers by individuals who have experienced adverse side effects caused by vaccines." (Washington)
