IMPOSE MAXIMUM SENTENCE ON SERIAL PUPPY/DOG KILLER- TYLER HASTINGS BERRY!

We demand justice for the 3 puppies and 1 dog killed in Tyler Hastings Berry's so-called "care". We ask that you impose the maximum sentence on this individual for his crimes. We believe that his misdemeanor charges should also be upgraded to felony charges. Berry is a repeat offender. He has shown himself to be wreckless and dangerous with no regard for life. Many animal abusers/murderers go on to harm humans, whether it be adults or children. It is NOT ENOUGH to slap Berry with a fine and temporarily ban him from having animals in his posession. Berry has done this with 4 DIFFERENT DOGS! That's 4 lives that he ended because of his horrific crimes! We STRONGLY ASK that Berry be given the MAXIMUM POSSIBLE SENTENCE and that his misdemeanors are upgraded to FELONIES to bring justice.

Tyler Hastings Berry (DOB: 8/12/1994 Age 27) of Texas is accused of torturing and killing puppies and dogs after getting them off of Facebook. The killings took place across Austin, Texas in various hotel rooms.

Berry is facing third-degree felony charges after a dead pit bill mix was discovered in his hotel room at the Doubletree Suites at 303 W. 15th St. on June 28, 2021.

The affidavit said the dog was found by the cleaning crew a day after Berry checked out, along with numerous hypodermic needles and drug paraphernalia.

A veterinarian with the Austin Animal Center determined the dog may have been strangled or partially drowned around 24 to 48 hours before its death.

"During those 24-48 hours, the dog would have been slowly dying and experiencing an unimaginable amount of pain and suffering, until its eventual death," the document said.

Police recognized Berry's name from another incident on June 5, when a wet, dead puppy was allegedly found in his room after he checked out from a different hotel. No officer was dispatched to that incident and no charges were filed because the puppy's body was thrown away by hotel staff, the affidavit said.

Berry does face charges over a third incident on Aug. 2 in which two dead puppies were found at another hotel in northwest Austin where he stayed. An investigation showed those puppies died from a lack of medical care.

The affidavit said Berry was arrested on Aug. 8 when he returned to the Doubletree Suites for another stay. His girlfriend, who was with him at the time, reportedly told officers Berry would get dogs off Facebook, "but then they would disappear."

"Berry told her that he gave them away or that they ran away, but that his stories about the dogs was always 'fuzzy,'" police said.

Berry is charged with two misdemeanor counts of cruelty to non-livestock animals in relation to the puppies so called "neglect" which resulted in their deaths and third-degree felony cruelty to animals over the pit bull's death, court records show.

AFFIDAVIT AND APPLICATION FOR ARREST WARRANT

The Undersigned Affiant, who after being duly sworn by me, on oath, makes the following statement:

I have reason to believe and do believe that: Tyler Hastings Berry, DOB (8-12-1994)

did then and there,

on or about 08-02-2021 at 10001 N. Capital of Texas Hwy #215, Austin, Travis County, TX commit the offense of:

CRUELTY NON-LVSTK:FAIL PRV- (Class A Misdemeanor)

Affiant is Detective Tim Diven #4417, an Austin Police officer assigned to the Animal Cruelty Unit.

Your affiant has been employed by the Austin Police Department for, 21 years and has been investigating Animal Cruelty for the last 9 years. Belief of the following statement is based upon personal investigative knowledge, witness statements, and information provided by Austin Police report #21-2140910.

On August 2, Austin Police Officer Reed:#6822 responded to a 911 call from the Hyatt House located at 10001 N. Capital of Texas Hwy., Austin, Travis County, TX. The caller, Joshua Owens, the hotel manager, advised that a guest had checked out of room 215 and his staff had located a deceased puppy and hypodermic needles within. Owens provided Officer Reed the name of the guest as Tyler Berry. Officer Reed found-Berry had APD involvement, including 2 prior and similar cases of animal cruelty (one of which your affiant just filed a felony warrant on Berry for animal cruelty; the warrant is currently active with a $20,000 bond). Officer Reed was shown the hotel security footage of Berry and was able to compare Berry's mugshot and DL photo to the video and it was a match for Tyler Berry. 

Owens advised that Berry had checked in on July 30th around 11:03pm and then checked out on the morning of August 2nd. Staff found the puppy when they went to clean the room.

Officer Reed entered room 215 and found the deceased puppy on the top of a full trashcan in the bathroom. The puppy was white with brown spots and was clearly deceased. Officer Reed noted that there was dog food and a food bowl in the bathroom. He also observed dog pee pads in the bedroom area as well as a fake patch of grass. In the cruelty case against Berry with the active warrant, that deceased dog (an adult dog) was found in almost identical circumstances. The puppy was removed by Animal Control and taken to the Austin Animal Center (AAC) so a necropsy could be performed. This puppy was assigned identification #A840131 and was estimated to be only 6 to 12 weeks old.

On August 3, 2021, APD Officer W. Tietz#6832 was called back out to this same hotel as staff had located another deceased puppy in that same room. After the first puppy was found and removed, hotel staff did not clean out the room until the following day. Upon emptying out the same trashcan where the first puppy was found, a second deceased puppy was found buried down in the bottom of the trashcan. This dog was also a puppy and was brown with white spots. Your affiant advised Officer Tietz to have Animal Control pick up this body for a necropsy as well. That puppy was given identification #A840204 and was also so estimated to be 6 to 12 weeks old.

Dr. Estep DVM conducted a necropsy on both puppies. He advised that both puppies were thin and had no food in their intestinal system (which means at least 2-3 days without food). The white puppy (A840131) had a large number of roundworms and Dr. Estep believes it died as a result of "overwhelming parasite infection and inanition" (lack of nutrients). The brown puppy (A840204) had evidence of pneumonia, and it had "some pulmonary edema and emphysema that could indicate suffocation or drowning" (due to the pneumonia). Dr. Estep believes these puppies were neglected to the point that it caused their deaths and that both puppies would be alive if the owner (Berry) had provided the puppies with standard animal care (to include food and medical care).

Your affiant met with the hotel manager, Owens. Owens confirmed the check in and out days for Berry. He advised that a driver's license check is performed when guests check in to the hotel and that was done when Berry checked in. He advised that no other guests were with Berry and no person or animal was listed on his room, other than himself. Owens was also able to look up the form of payment for Berry and Berry paid with a Mastercard. This same Mastercard was used by Berry at several other local hotels, and where other deceased dogs were found.

While investigating Berry for the other animal cruelty cases, your affiant spoke to Berry's girlfriend, Elizabeth Masters. Masters advised that Berry would regularly get new dogs and puppies from Facebook. She said the dogs would then just disappear and that Berry advised that he gave themaway. Masters advised that his explanation of what happened to the dogs was always "fuzzy".

On August 8,2021, Berry was arrested for unrelated warrants. APD officers spoke to him in regards to his past (they were aware of these cases against him). Berry told the officers that the dogs were sick when he got them and claims they all must have died from parvo. Dr. Estep conducted parvo tests on both dogs and they were negative for parvo.

It is your affiant's belief that Berry was the sole occupant August guest of room 215 from July 30th to August 2nd. It is also believed that Berry was the owner and caretaker of 2 puppies, as evidenced by the numerous dog related items in the room (pee pads, fake grass, dog food, dog bowls, etc). It is also known that the 2 puppies died from easily treatable conditions and that Berry failed to provide the puppies with basic animal care to maintain them in a state of good health.

This warrant/affidavit is for the brown puppy A840240.

Affiant asserts Tyler Hastings Berry committed Cruelty to Non-Livestock Animals when the person intentionally, knowingly, or recklessly failed unreasonably to provide necessary food, water, care or shelter for an animal in the person's custody. "Necessary food, water care or shelter in this chapter includes food, water, care, or shelter provided to the extent required to maintain the animal in a state of good health.
