Y ALTO A LA MILITARIZACION DEL NORORIENTE DEL PAIS

El Estado de Sitio en Guatemala es la cuarta de las situaciones especiales contempladas en la Ley de Orden Público, que se aplica en caso de que esté en peligro la estabilidad de las instituciones sociales y estatales y, por ende, la vigencia misma de la Constitución Política de Guatemala tiene por objetivo restaurar el pleno ejercicio de la Constitución, tanto en su parte orgánica como en los derechos y garantías, pero no el de alterar el sistema constitucional (Sáenz, s.f.).

El Organismo Ejecutivo puede decretar el Estado de Sitio con motivo de actividades terroristas, sediciosas o de rebelión que pretendan cambiar por medios violentos las instituciones públicas, cuando hechos graves pongan en peligro el orden constitucional o la seguridad del Estado, o se registren o tuvieran indicios fundados de que ocurrirán actos de sabotaje, incendios, secuestro, asesinato, ataques armados contra particulares y autoridades u otras formas de delincuencia terrorista o subeversiva (Diccionario Municipal de Guatemala, 2009).

Las y los migrantes guatemaltecos agrupados en La Red por la Paz y EL Desarrollo de Guatemala, amigos y amigas en solidaridad, ante la declaración del Gobierno de Guatemala de un "Estado de Sitio" en varios municipios del noreste del país el día Miércoles 4 de Septiembre, como consecuencia de la muerte de tres soldados en una "supuesta" emboscada, cuando un grupo de 15 militares pasaba por la aldea Semuy II del municipio de El Estor en el Departamento de Izabal declaramos.

Coincidimos con la declaración del Procurador de los Derechos Humanos de Guatemala, Jordán Rodas, que insta a las autoridades a garantizar los derechos humanos de las personas que viven en la decena de municipios en los que aplicarán un "Estado de Sitio" por la muerte de tres militares. El "Estado de Sitio" afectará durante 30 días a los municipios de Tactic, Senahú, Tamahú, Tucurú, Panzós, Santa María Cahabón, Santa Catalina la Tinta, Chajal y Fray Bartolomé de Las Casas, en el departamento de Izabal; a los de Gualán, Río Hondo, Usumatlán, Teculután en Zacapa; Purulhá en Baja Verapaz; y San Agustín Acasaguastlán y San Cristóbal Acasuagastlán, en El Progreso.

Exigimos que las autoridades guatemaltecas respeten el órden constitucional asi como tambien los derechos y garantias individuales de las y los ciudadanos guatemaltecos que viven en las areas que se verán afectadas en los próximos 30 días por este "Estado de Sitio", hacemos eco de lo expresado por la Oficina del Alto Comisionado de Naciones Unidas a las autoridades competentes de hacer todos los esfuerzos "para esclarecer los hechos y garantizar la protección e integridad de las personas".

Responsabilizamos al Presidente de Guatemala Jimmy Morales, AL Ministro de la Defensa, Luis Miguel Ralda, y el Ministro de Gobernación Enrique Degenhart, asi como también a la Cámara deL Agro y el CACIF, las empresas mineras que operan en esas areas y empresas del cultivo de la palma africana; de cualquier acto de violencia, represión e intimidación a los residentes de estas comunidades, sus autoridades locales y organizaciones comunitarias que defienden el derecho a sus territorios, tierras y sus recursos.

Hacemos un llamado a la solidariad internacional a no dejarse engañar por estas maniobras del Gobierno de Guatemala que con el pretexto del combate al narcotráfico pretende criminalizar la verdadero lucha por los derechos que las comunidades Mayas de esas areas que llevan a cabo en la defensa de los territorios, la tierra y sus recursos.

Tambien hacemos un llamado a los ciudadanos de Estados Unidos a que velen porque su gobierno no aproveche esta coyuntura para seguir interviniendo en los asuntos internos de Guatemala y siga favoreciendo al gobierno corrupto de Jimmy Morales, justificando con estos hechos la continuación de ayuda militar que no es necesaria en Guatemala, al no estar el país en Guerra.

AND END THE MILITARIZATION OF THE NORTH ORIENT OF THE COUNTRY

The State of Siege in Guatemala is the fourth of the special situations contemplated in the Law on Public Order, which applies in case the stability of social and state institutions is endangered and, therefore, the very validity of the Political Constitution Guatemala aims to restore the full exercise of the Constitution, both in its organic part and in the rights and guarantees, but not to alter the constitutional system (Sáenz, s.f.).

The Executive Agency may decree the State of Siege in connection with terrorist, seditious or rebellion activities that seek to change public institutions by violent means, when serious acts endanger the constitutional order or the State security, or there is a well-founded indication that acts of sabotage, arson, kidnapping, murder, armed attacks against individuals and authorities or other forms of terrorist or subversive crime will occur (Municipal Dictionary Guatemala, 2009).

Guatemalan migrants grouped in La Red por la Paz y EL Desarrollo de Guatemala, friends in solidarity, before the declaration of the Government of Guatemala of a "State of Site" in several municipalities in the northeast of the country on Wednesday, September 4 , as a result of the death of three soldiers in a "alleged" ambush, when a group of 15 service members passed through the Semuy II village of the municipality of El Estor in the Department of Izabal we declared.

We agree with the statement of Guatemala's Human Rights Attorney Jordán Rodas, who urges the authorities to guarantee the human rights of people living in the ten municipalities in which they will apply a "State of Siege" for the death of three service members. The "State of Siege" will affect for 30 days the municipalities of Tactic, Senahú, Tamahú, Tucurú, Panzós, Santa María Cahabón, Santa Catalina la Tinta, Chajal and Fray Bartolomé de Las Casas, in the department of Izabal; Gualán, Río Hondo, Usumatlán, Teculután in Zacapa; Purulha in Lower Verapaz; and San Agustín Acasaguastlán and San Cristóbal Acasuagastlán, in El Progreso.

We demand that the Guatemalan authorities respect the constitutional order as well as the individual rights and guarantees of Guatemalan citizens living in the areas that will be affected in the next 30 days by this "State of Siege", we echo the statement made by the Office of the United Nations High Commissioner to the competent authorities to make every effort "to clarify the facts and ensure the protection and integrity of individuals".

We hold Guatemalan President Jimmy Morales, The Minister of Defense Luis Miguel Ralda, and the Minister of Government Enrique Degenhart, as well as the Chamber of Agro and CACIF, the mining companies operating in those areas and companies growing African palm; of any act of violence, repression and intimidation of residents of these communities, their local authorities and community organizations that defend the right to their territories, lands and resources.

We call on the international solidarity not to be fooled by these maneuvers of the Government of Guatemala that under the pretext of combating drug trafficking aims to criminalize the true struggle for the rights that the Maya communities of these areas that carry out in the defense of the territories, the land and their resources.

We also call on the citizens of the United States to ensure that their government does not take advantage of this situation to continue to intervene in Guatemala's internal affairs and continue to favor the corrupt government of Jimmy Morales, justifying with this incident the continuation of military aid that is not necessary in Guatemala, as the country is not at War.
