Dear Property Owners & Neighbors,
Some of you might be aware of the constant strife and struggle that is currently occurring with our HOA Board. It seems that instead of improving our community and spending our money wisely they are more interested in spending it on lawsuits to enforce items that are not enforceable by our governing documents. While there is paint peeling from our parking structures and balconies flooring, they are giving raises to service providers such as maintenance, property management, and attorneys. When asking the board or property management to follow its own documents they pretend they do not exist or follow a new set of rules & regulations that were never approved or do not exist. It seems that the main culprit behind all of this is Margarita Brown who since taking over as treasurer has also listed her unit on the market. While this is very odd she still controls every decision for our beloved community even though she no longer wants to retain a stake in it. There are also major technicalities that make it difficult to overthrow and stop the abuse. As of right I do suspect that there are major things with both the HOA finances and contracts that are not up to par and that odd processes are going on behind the scene. I believe if we do not want to be looking at a $450.00 dollar or more even $500.00 dollar monthly due by 2021 that we step in and regulate what is going on here. There have been increases which in part are normal and on the other hand we are honestly getting nothing back for it. I have seen maintenance take on side projects and getting paid on the side for them while we are all paying for them to take care of repairs on the grounds, or idle by and chatting around. We have board members that should not legally even be on the board due to not owning shares but getting away on a technicality. They spend more time squabbling over petty things than actually helping the community. Our reserves are not in great shape and the money we do spend should be carefully analyzed and projects categorized appropriately. If you check the current minutes which they have skipped many times over the past 12 months, you will see that Margarita Brown leads all of the meetings and approves every decision. What we all are truly trying to understand is what power she holds over everyone else? Please join me in a full and total recall of all Board Members and the cancellation of all contracts in order to start again fresh and put us all on the right track. I propose the following items to the imperative in the election and selection of the next board members:
• No Board Member shall receive kickbacks legally or illegally, or know anyone from a service provider or establish friendships as it hurts the collective as a whole.
• Money shall be sent first and foremost on infrastructure needing repair, prior to landscaping or any other amenities projects. Projects shall be under scrutiny by the community at any time and a basic petition with just 25 signature can stop the process
• Our Reserve shall reach a minimum of $1.2 million dollars a remain at that status as a minimum standard.
• The board will be prohibited from intimidating residents and shall follow every CC&R, Rules and Regulations and other process set forth by when the community was established.
• A new management company shall uphold a certain standard of professionalism and shall notify residents appropriately of shut offs, maintenance, etc. with at least 48 hour notice. Unless it is an emergency project which shall still be notified immediately.
• All financial documents and copies shall be kept digitally on a secure site and accessible to all residents to review up to 3 years back. Including all invoices, spending, salaries, contracts, and all other operations of the HOA. This is to ensure complete and total transparency of finances and dealings.
• All board meeting shall be broadcasted for viewing.
• Voting on issues shall change from paper ballots to a third party digital system allowing for constant voting on issues and keeping residents in control of the board.
Our board is no longer functioning as it should, when an individual purchases a unit it enters into a contract. Currently the board believes that it is a type of monarchy or absolute dictatorship and that will ultimately hurt us all in the long run. Please join me anonymously and sign
