Our H.O.A. dues have been increased without a vote of the homeowners. We have many questions and we want a special meeting to get those questions answered and to vote on whether to have the increase,

We are now ready to go to court regarding the unauthorized increase in dues.
We have more than 45 verified signatures from volunteer plaintiffs.
We have the formal complaint drafted by our law firm (adjusted to reflect the last-minute response by the HOA)

The HOA has responded saying we don't have the required number of signatures. Care2 cannot tell your full name nor your street address to a third party. We will prepare for court by getting the required number of petitioners to sign-in as plaintiffs. There will be a 90 day lag between the final demand to the HOA and the filing of the case. Our attorney sent demand letters and emails to the HOA on 1-3-25. HOA has 5 days to respond. Demands: 1-acknowledge the petition; 2-have the Special Meeting where we vote on the issue ; 3-follow the Bylaws. Please donate to our legal fundraising at https://gofund.me/49a20734. Lawyers are expensive but we will loose more than $300,000 collectively in 2025 unless we fight the unjustified increase in dues. OUR PETITION TO VOTE WILL NOT BE IGNORED. It has been 21 days since we delivered a supermajority-signed petition to vote on the proposed increase in our dues. We followed our rules. Now the Board of our HOA refuses to follow our rules. They are not above the law. We now must retain legal counsel to fight for our right to a special meeting where we get to vote.
