Why Aren't the Children Protected?
When allegations of child sexual abuse arise during a custody case, unfortunately, the professionals who are involved often look first to question the motives and veracity of the protective parent rather than to what they can do to protect the child. Most people think that making allegations of sexual abuse is a sure way for the protective parent to win the custody case. Nothing could be further from the truth.
There is a backlash in full force in our legal system against protective parents. "Protective parents" are those acting to protect their children from abuse, be it physical or sexual. Protective parents are, much more often than not, mothers. The Fathers Rights Movement has been built on the myth that evil mothers have lodged false allegations of sexual or physical abuse or domestic violence against millions of fathers just to deprive and alienate them from their children.

As we see women of power stepping forward we are encouraged in pointing out this extreme injustice and inequality that is happening to mothers reporting abuse of themselves and their children. This inequality is putting thousand of children in abusive homes right here in Albuquerque. New Mexico can't rank #2 in child abuse without an extreme failing of the courts, CYFD, CPS and also the system failing of parents. Mothers are loosing custody of there children for reporting abuse in the courts, and It's so bad that lawyers are now advising their clients to not report spouse abuse or child abuse if they want a life with their children.

Noting: that negative stereotypes about women encourage judges to disbelieve women's allegations of child sexual abuse. Gender bias problems are particularly acute in family courts, and most problematic when sexual abuse of children is alleged in custody or visitation proceedings. The report stated: "One striking example is the tendency to doubt the credibility of women who make these allegations, and to characterize them as hysterical or vindictive even when medical evidence corroborates a claim of child abuse."

Another major problem area involved child custody and visitation disputes between parents when there has been a history of domestic violence. The committee also found that custody and visitation orders frequently fail to include adequate provisions to prevent further abuse, giving batterers unrestricted access to their children and therefore unrestricted access to their abused spouse" Link to full report


Solutions to end child abuse in New Mexico:
1: Set forth some bills to change the laws that protect those that harm children such as: Judges (like immunity when they've made a mistake that violates human/constitutional rights), Lawyers (being able to manipulate the system however they want to win their case, rather act in the best interests of the child/follow Constitution and current law and determine/counsel their client as such), Court-appointed Experts (being privately paid with no over-site and allowed to make decisions as a judge with no checks and balance, and only being allowed to enter a case when all else fails) and Parents (need proper representation on both sides, it should not be about winning in situations of abuse, there should be proper protection and punishment when abuse has been proven, and no parent should be alienated simply for reporting abuse or not getting along with the other parent, ever).
2: We also propose that parents have the same rights as criminals to have council/attorneys if they cannot afford council. We also propose that these trials in which one of the parents have been accused of abuse that there be juries present for over-site and and fair judgment and prosecution of abuser.
3: To end privatized custody evaluators/Guardians ad Litem (any privately paid court-appointed "Experts") and that we state-sponsor Licensed caseworkers/social workers through CPS or CYFD to follow families through the entire court process when dealing with domestic violence and allegations of sexual abuse against children.
4: Mandatory drug and alcohol screening for judges, and Full Psychological Screening before ever being allowed to take the Chair as a Judge.
5: Yearly Psychological Supervisory and Gender-bias/Fair and Just evaluations of judges by the Gender-bias Task Force that's already established in federal circuit courts in 45 states.
6: We propose that APN and any other supervised visitation services stop being Privately Paid Only, adopt a state-sponsored program for low income families; And employ in-House advocates (that oversee and are able to determine their own opinions and possibly make recommendations-over time-to the court if they see a glitch in the current order). Checks and Balances. that they work with caseworker/social workers through CPS or CYFD, to insure that good parents are not being alienated and that proper reintegration can take place or is allowed when there are no signs of abuse.
