Gary collected rainwater on his property.
The law states tributaries can not be blocked.
Gary did not block any tributaries.
Oregon law does not apply to rainwater.

Gary Harringtion was falsely charged for storing rain water, improperly prosecuted, and jailed.

OWRD has no jurisdiction over rain and snow melt run off…Its not subject to the law of appropriation.

He had his Due Process rights violated multiple times by the Judge, the Prosecution and  OWRD.

The OWRD Watermaster and his assistant did not have their required Oath of Office made or maintained.

Gary was targeted and selectively prosecuted, and a civil investigation ran concurrently with a Criminal investigation against him.  

A null and void complaint was used to try him and He was denied counsel of his choosing. Then he was rushed into judgment by a Judge that was not impartial and the Jury was denied hearing all of Gary’s evidence.

His Doctor has determined he is at high risk of reinjuring recent hip replacement and has asked for the needed delay of jail sentence.

He is in jail while the Judge, the Prosecutor and the OWRD, who we believe are guilty of multiple crimes and violations, are not being penalized for acting in Bad Faith and breaking ORS requirements in the same body of law. 

Gary should be released immediately and his case be dismissed, or at least his sentence delayed until the U.S. Supreme Court hears it if need be.
