BULK PROPANE PROJECT THREATENS RESIDENTS IN COCOA, FL

This is to petition an unlawful zoning approval by Brevard County, FL commissioners, officials and agencies for 60,000gals of liquid propane bulk storage by the Ideal Gas company feet from homes in Vanguard Estates and Missile View Trailer Park at 512 Cross Rd, Cocoa, FL. Additionally, the EPA worse-case release model determines the hazard or damage radiates to one half mile for a catastrophic event and fire rescue evacuates to one mile for facility fires. This great risk to public safety is common sense to most even without the proof of county code law and EPA data. The construction site and property at 512 Cross Rd is zoned light industrial IU. This is not in dispute. The principle chemical use and storage operations of the proposed business iDeal gas (bulk liquid propane distributor) out of St. Augustine, FL and landlord property owner Joann Fayne of Cocoa is defined as heavy industrial IU-1 section 62-1544. County code law "Section 62-2262 Fire and explosion hazards" states "In the IU-1 district only, the storage......of flammable liquids or material which produce flammable or explosive vapors is permitted". "Section 62-1543 light industrial IU" states its "uses...take place within an enclosed building". By its inherent operations 60,000gals or even 30,000gals of bulk propane storage is outdoors and by definition not compliant with the light industrial property at 512 Cross Rd even if it were not next to residential.

These exact code law language cannot be credibly disputed. It should end there, but it's recklessly apparent the county conjectures "Sec. 62-1540. - Industrial uses permitted with conditions and conditional uses" gives it an interpretation it wants. However, nothing can be found in actual code law to support any interpretation let alone exact code language that would make the heavy industry use propane legal on light industrial zoning classification. Section 62-1540 explains other possible "uses" on light industrial – IU. These uses might be possible by CUP – conditional use permit, but this requires application to a county zoning board, naming the specific use like liquid propane which was not done, also proof neighbors properties would not be devalued by more than 10% and among others sending notice to neighbors in a timely manner. This was never done. The county publicly stated a CUP was not used. That leaves only a legal approval by way of Pc – Permitted with conditions. Once again this permit has requirements that the "use" meet or be controlled by code law sections 62-2251 through 62-2271. Multiple sections are easily found to support non-compliance on light industrial most importantly is the above mentioned 62-2262 Fire and explosion hazards. Furthermore, section 62-1102 providing Industry definitions states plainly "Heavy industry means....324 Petroleum and coal products". Propane's chemical name is Liquefied Petroleum Gas. Could it be any clearer? Additionally, near by precedents were set when the City of Melbourne, FL and Titusville, FL both received applications for above ground explosive hazard bulk storage and were terminated when abutting neighborhoods protested. Those governments honored public safety and other life concerns. The stop ideal gas group submitted almost 350 residents and businesses signatures in a petition October 23 above 95% of those who answered the door in a half mile radius signed. It's just common sense. The substantially and credibly evidenced petition went unresponsive by county commissioners, county attorney, county manager and others.

Brevard County fire department intends to use the organization called NFPA, National Fire Protection Association where its information offered as guidance only appears tainted by its government and government contracted members. NFPA makes no reference or guidance for separation distance to residential and Brevard County refuses to discuss the human population and hundreds of homes inside the explosion hazard distance one hundred just across the street. In contrast a multi page study with mapping was reported on the safety of the Gopher Tortoise, but the fact residential zoning and renters exists across two neighborhood streets from this explosion hazard was concealed withheld in zoning process documents for over two years before construction began in April. Of course they knew it would not be welcomed and without any notice petitioners were left at a disadvantage in time to educate, organize and appeal to all proper departments and offices. Even our so called public servants Senator Debbie Mayfield, Rep. Tyler Sorois and U.S. Rep. Bill Posey all refused to give any support for law and order and the people's peace and dignity.

We don't know why Brevard County is acting with such reckless disregard without care for severely disabled, elderly and families. Never even one contact initiated from the fire department or commissioners. In fact dodging has been their game. After exhaustive efforts the county has refused to respond to county code law sections and definitions. It's rational to think corruption is a motive and a Tallahassee propane lobby firm money may be a factor. Especially the District 1 Commissioner Rita Pritchett who will not return for election when her term is up in 2024 and may intend to move on to a private career in lobbying. This has been the recent case with previous Brevard county commissioners.
