Recharter the Ashburn Farm Home Owners Association (Ashburn VA)

We, the undersigned, as Ashburn Farm property owners oppose the abusive use of authority by the Ashburn Farm HOA; therefore, through this petition we alter the HOA charter, redefining it to explicitly define its Constitutional authority, to formally recognize the difference between legal and moral authority, to acknowledge that it receives only legal authority from its residents and thus it has no authority to limit or control residents’ Constitutional rights. It is to recognize that its primary obligation is a moral one which is to protect and defend the sovereign rights of residents in all of its duties and to fulfill this responsibility it may use lawfully collected revenue. Lastly, it is required to get involved according to its ability to support residents in cases where other government powers may be seizing citizens' rights.

To Ashburn Farm Property Owners:

Like many property owners associations before it, officers of the Ashburn Farm HOA has begun to exercise authority they do not possess; authority guaranteed by our U.S. Constitution to the people which cannot be subsumed or contracted away; specifically speaking, it is the assumed right to tell homeowners how and when to care for privately owned property which runs contrary to constitutional protections. And, it is the responsibility of all citizens of these United States to correct this behavior and to defend the rights of all community residents. Since the unconstitutional authority assumed by the HOA is written into its charter, resolving the issue requires altering this charter; therefore, a CONSTITUTIONAL HOMEOWNERS AGREEMENT has been written that would restore principles of our U.S. Constitution and to return authority to the people to whom it belongs while retaining the services of the HOA in maintaining our community. When homeowners close on their homes they sign a DECLARATION OF COVENANTSRESTRICTIONS, the homeowner agreement, containing rules, regulations and standards of the community which buyers agree to live by; this is also where a conflict of interest arises for the Association and its officers since it has the obligation of working within constitutional limits while also following a Declaration of Covenants that tells it to create and enforce laws that ignore it. This new CONSTITUTIONAL DECLARATION eliminates this conflict by explicitly acknowledging the sovereign authority of Owners and describing how the Association may perform its duties appropriately. It rearranges the Association’s purpose so its officers care more about people than property while still maintaining community property.

This NEW COVENANT protects constitution rights by recognizing property owners as sovereign over their property while it is owned and supporting the Association to protect and defend community standards when the property is resold or transferred. Thus, property owners are free to do what they will with their property while it is owned but community standards are enforced when ownership is transferred; thus, maintaining the attractiveness of the community. This arrangement also encourages the Association and its officers to lead by example rather than governing by force.
