Another news update on Diablo the pitbull.
A lawsuit naming two Monroe County Sheriff’s Office deputies as defendants has been filed over the shooting death of a dog in Perinton.
Deputies Shaun LeClair and Matthew Clancy are cited in the legal complaint, filed in state Supreme Court Thursday, for their alleged role in the death of a pit bull named “Diablo” who was shot and killed on the property of the dog’s owner, and plaintiff, Gary Brockler, at about 11:35 p.m. on June 1, 2012.
Diablo was shot five times with police service weapons, after LeClair and Clancy responded to a complaint of a vehicle illegally parked in front of Brockler’s home, the criminal complaint says.It adds that Diablo, was secured on the property by an electronic fencing device, and was shot after police entered the property without cause.
In June, Monroe County Sheriff Patrick O’Flynn said after an internal investigation, LeClair and Clancy “acted in accordance with their training.”
On the night of the incident, O’Flynn said several cars were parked on the sidewalk in such a way that people had to walk in the street or onto Gary Brockler’s property to get around them.
LeClair and Clancy were on their way to Brockler's door to have him move the car when the pit bull, Diablo, came out from under a garage door. When they moved to the side, the dog kept coming, so the two deputies discharged their weapons, O'Flynn said.
Brockler is seeking $10,000 for damage to his property from bullets, and is looking to recover all expenses related to the ownership of Diablo.
