Petition Against The Contemplated Approval by the Trustees of the Village of Mount Kisco (the "Village") of the Installation of a Cell Phone Tower (the "Tower") on the Grounds of the Water Tower in Mount Kisco Chase (the "Installation")
I am a resident of or an owner of a home in Mt Kisco Chase. I am signing this petition against the Installation for numerous reasons, including the following:
1. The Installation is in violation of the intent of the transfer of the subject lot of land between Mount Kisco Chase, L.P. and the Village dated January 14, 2004. The sole purpose of the transfer of the subject lot was to address water pressure issues within Mount Kisco Chase by installing a water tank.
2. The installation would constitute an illegal use of the subject lot, in that said lot is part of a Conservation Development District, and the installation is an impermissible use under Section 110-7 (B) of the Code of the Town/Village of Mount Kisco.
3. The incompatible aesthetics of the Tower with the quiet, residential family neighborhood of 86 homes comprising Mount Kisco Chase ("MK Chase"). The Tower will be in very close proximity to most of the homes in MK Chase. Attempts to mask a Tower with faux greenery will not be compatible with the aesthetics of MK Chase or the surrounding topography;
4. The potential health risks to infants, toddlers, young and older adults, pets and wildlife associated with (a) exposure to wireless microwave radiation emissions and (b) noise pollution generated by an operating Tower or support equipment;
5. The decrease in MK Chase home values due to perceived negative health effects and due to the aesthetic issues related to the Tower. Several current homeowners will seek to move away from MK Chase, which will itself lower property values. Home values will decline further as potential homebuyers will not desire to purchase a home in MK Chase due to the Tower. Declines in the value of the 86 homes in MK Chase will result in lower property taxes paid to the Village;
6. The proper maintenance of the Tower may be required at any time, day or night, which will increase the number of trucks and service personnel in MK Chase, negatively impacting the safety, comfort and quiet enjoyment of MK Chase residents and guests;
7. The increased potential for fire in MK Chase due to the Tower whether resulting from equipment malfunction, Tower maintenance personnel or a weather event; and
8. The existing adequacy of cell phone and wireless data coverage throughout MK Chase does not support putting the residents of MK Chase or the surrounding areas at risk for health or safety issues, or decreasing the value of 86 homes.
