 I lost the man I love to a MURDER. He was murdered while visiting family 1100 miles away in Illinois. 56 days later his son was born. I became aware there is NO WHERE state, federal, or non profit to help enlist my son's father as his father. The burden is mine and mine alone. I must find a way to prove paternity. The District Attorney 1100 miles away refuses to release the portion of the blood card for paternity purposes although there are multiple samples on file. stating "it is evidence". I want my son protected from ever being referred to as an "alleged child" or "alleged victim". What I've encounter is nothing short of torturous. I only wish to protect my child and children like my child, mothers like me, families like mine. The bill I've complied protects the mothers and the unborn victims and this sadly is very NEEDED in today's society. Please sign ask your friends to sign WE NEED YOU! BE IT ENACTED BY THE CONGRESS HERE ASSEMBLED THAT:

SECTION 1. Luke's law will protect and assist in proving/releasing state-collected DNA cards for proof of paternity for a child born after the death of the child's parent due to a crime or accidental death.

BE IT ENACTED BY THE CONGRESS HERE ASSEMBLED THAT: SECTION

 Section1. Luke's law will protect and assist in proving/releasing state-collected blood cards for proof of paternity for a child born after the death of the child's parent due to a crime or accidental death.

A. THIS BILL IS NOT INTENDEDFOR CHILDREN BORN PRIOR TO THE DEATH OF THE PARENT

SECTION 2. The County Coroner's Office in which the crime took place will be obligated to provide a sample from the blood card (collected by the County Coroner's office during autopsy) for paternity purposes. Within thirty (30) days of receiving the shipping kit from an accredited DNA diagnostic center, the portion of the blood card is to be released and shipped. This will allow the child born after the loss of a parent, due to a crime/accidental death to prove paternity and collect necessary documentation for the amendment of the child's birth certificate.

A. THE BLOOD SAMPLE MAY ONLY BE RELEASED TO AN ACCREDITED DIAGNOSTIC CENTER.

B. The legal guardian of said child will be responsible for cost of paternity testing and amendment of child's birth certificate.

SECTION 3. The District Attorney's Office in which the crime took place will oversee that the blood card sample be released for paternity purposes and shipped to an accredited diagnostic center within the allotted time period.

A. The District Attorney will be mandated to release the blood card regardless of ongoing investigations and/or proceedings.

 B. Only children born after the death of the parent apply to this Act.

SECTION 4. This Act shall go into effect within 60 (sixty) days of being accepted into law

SECTION 5. All laws in conflict with this legislation are hereby declared null and void.
