NOTICE TO PETITION AMENDING CCR #19 LIVESTOCK

It has been brought to the attention of the Board of Directors that there are two (2) different interpretations of CCR #19 contained within the Rancho Blacktail Subdivision's Declaration. The purpose of this petition is to amend CCR #19 as to provide a clear and fair interpretation for all concerned members without unduly discriminating against either party.
CCR #19 states:
"LIVESTOCK. One (1) horse per acre not to exceed four (4) head per lot. One (1) cow per acre not to exceed four (4) cow/calf pairs or four (4) yearling per lot. 4-H beef and lamb projects are permitted.
The purpose of this covenant is to prevent overgrazing of land which would cause dust and erosion. In no case shall any part of Rancho Blacktail Subdivision be so maintained that the natural vegetative cover is destroyed, except as is necessary for the location of utility lines, building or for lawns, gardes and cultivations."
*First interpretation is understood as one horse per acre up to 4 per lot AND up to 4 cows on the same lot for a total of 8 livestock.
*Second interpretation is understood as one horse per acre up to 4 per lot OR up to 4 cows on the same lot for a total of 4 livestock.

As stated in the beginning of CCR #19 it is a documented fact stated by the original author of the covenants, that one acre will support one (1) horse or cow. The confusing part is what follows when there are limitations added per lot. Limiting the larger lots doesn't have anything to do with overgrazing or Erosion.

In trying to find a clear and fair interpretation of CCR #19 for all present and future members of the Rancho Blacktail Subdivision, we propose to amend the wording only of such covenant as follows.
One (1) horse per acre or one (1) cow, cow/calf pairs, or yearlings per acre.
EXAMPLE: 1 acre=1 livestock, be it horse or cow
4 acres=4 livestock, be it horse or cow
6 acres = 6 livestock, be it horse or cow...etc.
This is based on Montana's National Range and Pasture Handbook.

In addition to the proposed amendment to CCR #19, a Pasture Management Plan will be put in place to help guide, govern and enforce CCR #19.
