Moris Martinez is a Hoosier immigrant from the Logansport area who has been unjustly detained in ICE custody for 9 months.

Moris has lived in the US for 29 years after arriving at the age of 9. He has lived in Indiana for over 20 years. He was the first person in his family to graduate from high school and one of the first Latinx individuals to graduate from Delphi Community High School in 1999. When his father passed away when he was in his twenties, he became the person that his mother, Maria, and his siblings turned to. Now, he loves being an uncle to his nieces and nephews! He desperately wants to see his mother and be reunited with his whole family.

However, Moris has encountered many of the oppressive systemic barriers in our immigration system. He previously had temporary protected status (TPS) but was not eligible for the process that allowed his mother and brother to obtain green cards (NACARA) because he was previously married at the time. He is also one of the Dreamers who is not eligible for DACA because of the narrow eligibility requirements. Nonetheless, Moris is eligible to obtain a green card when he marries his US citizen fiancé. However, in the last 9 months, his requests to be permitted to marry (which are normally permitted) have been denied due to unilateral COVID restrictions made by the jails where ICE holds immigrants in the Midwest. If he had been permitted to exercise his constitutional right to be married back in the fall he would have already applied for a green card and been permitted to continue the green card process in the immigration court. Moris Martinez es un inmigrante del área de Logansport, Indiana que ha estado detenido injustamente bajo la custodia de Inmigración y Control de Aduanas por 9 meses.

 

Moris ha vivido en los EEUU por 29 años después de llegar a los 9 años. Ha vivido en Indiana durante más de 20 años. Fue la primera persona en su familia en graduarse de la preparatoria y es uno de los primeros individuos latinos en graduarse de Delphi Community High School en 1999. Cuando su padre falleció cuando él tenía unos 20 años, volvió a ser la persona con que cuentan su mamá y sus hermanos cuando algo sale mal. Le encanta ser un tío para sus sobrinas y sobrinos y quiere desesperadamente ver a su mamá y a su familia.

Sin embargo, Moris ha enfrentado muchos de los obstáculos sistémicos en nuestro sistema de inmigración. Previamente tenía el estatus de protección temporal (TPS) pero no fue elegible para el beneficio de inmigración que otorgó tarjetas verdes a su mamá y a su hermano (NACARA) porque anteriormente estuvo casado. También es uno de los Dreamers que no es elegible para DACA por los requisitos estrictos de elegibilidad. No obstante, Moris es elegible para obtener una tarjeta verde cuando se casa con su prometida, una ciudadana estadounidense. A pesar de eso, durante los últimos 9 meses, sus peticiones de que le permitieran casarse (algo que normalmente está permitido) han sido negados debido a las restricciones unilaterales hechos por las cárceles donde Inmigración y Control de Aduanas detiene a inmigrantes en la región central de los EEUU. Si se le hubiera permitido ejercer su derecho constitucional de casarse el otoño pasado, ya se habría solicitado una tarjeta verde y ya se le permitiría continuar el proceso de solicitar la residencia permanente ante la corte de inmigración.
