GOV. CORZINE- STOP THE PORT AUTHORITY LAWSUIT

Whereas the BLRA, a Redevelopment Agency of the City of Bayonne has entered into an agreement to sell the "Maritime District" of the Bayonne Peninsula to Ports America for $40 million more than was offered by the Port Authority of New York and New Jersey (PANYNJ) for a total price of $90 million, and
Whereas an original tentative agreement between the BLRA and  PANYNJ was voided as a result of a meeting held in violation of the Open Public Meetings Act, and
Whereas the PANJNY  is now threatening to file a lawsuit against the BLRA in an effort to obtain the Maritime District for far below market rate, and whereas this lawsuit, as well as the sale of the Maritime District will result in irreparable harm to the financial health and welfare of the economy and budget of the City of Bayonne, and
Whereas it is unconscionable that a public entity, such as the PANYNJ, would sue to harm a municipality that chooses not to do business with them at far below market rate and without approval of the local Governing Body,
We the undersigned urge New Jersey State Governor Jon Corzine, who appoints and oversees Commissioners of the PANYNJ and who has the ability to exercise veto power over PANYNJ decisions, to STOP the PANYNJ from pursuing legal recourse against an Agency of the City of Bayonne that has instead chosen to enter into a legal, binding, and formally voted contract with Ports America.
