Bidi George DOB: 11/29/1997 was eighteen years of age, a student at the time of arrest, had no prior criminal or arrest records. Arrested on 16th November 2016 by the Suffolk County Police Department. Investigators at Suffolk County Police Department Assaulted Bidi by using a cruel and coercive interrogation tactic on him by handcuffing his two hands as he described it similar to the crucifixion. He was stripped down to his boxers by the police officers while Detectives at the Suffolk County Police Dept. turned freezing cold air from a air condition directly on him in November, they interrogated him for over 24 hrs, coercing and threatening him to admit to multiple crimes he didn't commit or knew nothing about. Bidi was Indicted on one count of Burglary a class B felony and was charged with a firearm even though the Arresting officers stated on record there was no Firearm found.
Bidi George was arrested and held in Jail for One Year and Six Months and was not brought into a Court of Law for trial, Jury selection or any Critical proceedings until the day he was sentenced.
The Law provides that all States must abide by the Federal Rules of Criminal Procedures which grants to ALL the rights to be heard before an impartial tribunal. (Rule 23- Federal rules of criminal Procedure).
A defendant is entitled to a Jury trial unless waived in writing. Bidi's rights to Procedural Due Process of Law was blatantly denied when he was not given the chance to be heard in the Court of Law.
The 6th Amendment Rights of Accused in Criminal Prosecutions states, "The right of Confrontation is one of the fundamental guarantees of life and liberty... that in all criminal prosecutions the accused shall enjoy the right to a speedy and public trial by an impartial Jury of the State and District wherein the crime shall have been committed.
"The Primary object of the (Confrontation Clause) is to prevent desposition of ex parte affidavits being used against the prisoner in lieu of a personal examination and cross-examination of the witnesses in which the accused has an opportunity not only of testing the recollection and sifting the conscience of the witnesses, but of compelling him to stand face to face with the Jury in order that they may look at him, and judge by his demeanor upon the stand and the manner in which he gives his testimony, whether he's worthy of belief be confronted with the witnesses against him." Crawford v. Washington. Citation: 541 US 36 (2004).
Bidi was denied the right to face his accusers. The Procedure used by the Court was constitutionally inadequate, but the Court acted to deprive Bidi George of Life, Liberty and Property.
The eight Amendment clause prohibits all cruel and barbaric methods of punishment. The 5th and 14th Amendment prohibits all states from depriving any person of life, liberty or property without Due Process of Law. Bidi was given an excessive bail of ONE MILLION DOLLARS! A total violation of the 8th Amendment clause.
On May 3rd,2018 Bidi George was given an unlawful, cruel and barbaric sentence of 25 years wt 5 years post release by a corrupt Judge, Mark D. Cohen- #1367994 and the corrupted Suffolk County Former Chief D.A. Thomas J. Spota- #1146679.
*NOTE
Thomas J. Spota resigned November 10, 2017, upon indictment of federal charges of obstruction of justice in the Suffolk County Police Chief James Burke assault cover-up investigation case. Spota was found guilty! He was disbarred on June 10, 2020.
THOMAS SPOTA WAS SENTENCED TO 5 YEARS AND IS SCHEDULED TO REPORT FOR SENTENCING BY DECEMBER 10TH 2021.
