My name is Amanda Tate and I have 3 beautiful and amazing kids. I have been employed with the same company for going on 5yrs and have worked my way up to the RGM position at the store, and have successfully been a RGM for almost 2 years. One look at my home and my life and you would never guess it but I am a recovering addict as well. I have been sober for 4 n 8 months now and am very strong in my recovery. Things weren't always so great. In 2011,I was a full blown drug addict , snorting and shooting anything I could get my hands on. I lost my cars, house, belongings, some family and friends, money, self worth and pride, and most importantly my rights to my kids. The CPS wanted me to engage In a six month improvement period, however I refused and stayed intoxicated on my drugs because I wasn't ready. I was high the day of my disposition hearing and wasnt informed about it and I didn't show up. They terminated my parental rights. I didn't realize what this meant then. The amount of drugs I was Doing had me blinded and numb to the situation. Was I in for a surprise. 2 months after the termination I woke up and had a spiritual awakening and realized I needed to change. I was sick and tired of being sick and tired. I signed myself into a rehab and stayed for almost a yr. I regained my life back and eventually my kids. I went back to court and proved how well I was doing and asked for visitation of my kids . The courts told me it was up to the custody holders at the moment who was my twins' dad and my daughters grandmother. Things went well with visits. Eventually my daughters grandmother just gave me back my daughter. She has been back with me for 2 yrs. she is stable, happy, and very well taken care of. I am still sober, still working, and support her financially with no help from the state or her grandmother. I've never asked or needed it Life was perfect. I say was because one year ago today WV CPS came to my home in Ohio in which my daughter was back with me for 2 whole years and forced me to give her to them, regardless of how much it hurt her. She sat in a foster home, scared , confused , and worried for two months. The courts placed her back with her grandmother. The CPS worker said I was breaking the law by having her with me. Even though I'm sober and turned my life around and even though she is stable and well taken care of , and no reports on us for the past 2 yrs , it's still not through the courts. They have emotionally harmed my daughter and ripped our life apart. The pain and traumitizatuon she is enduring right now and then is something she will never get over or should never be going through as an innocent child. After almost 5yrs I think I have proven who I have become and who I am to her and to my older children. I currently recieve visits with my kids and have never missed a single one. I work hard everyday 50/70 hrs per week, i am able to financially provide for them, i am clean and sober and can prove that, and i can provide the love support and motherly guidance that they need through this life. I deserve my parental rights reinstated.She should of never been hurt and confused by this . I also have 2 older children who are almost 16 who have been emotionally and mentally harmed by this entire situation. They are very close to their sister and want her back home. They also are older and they know how well Im doing and how far I have come on this journey , they also both want the courts to reinstate my rights. I am asking the WV legislature to pass the bill for reinstatement of parental rights in WV if a person can prove a clear and convincing change of circumstances and a certain amount of time behind the change with clear and convincing evidence . There are currently 9 states that have this law in effect let's make WV one of them. So we can bring Kailee home where she belongs Thank you for hearing my story, this is for my babies💜. Also I am listing what the current law is and what law I am petioning that WV change n pick up...
Current WV law is.. Code 49-6-6 if a person's right are terminated, A child , parent of the child, or the department may petition the court for reinstatement unless the child has been adopted. If a child has not been adopted the courts can reinstate the terminated parent's rights if it is proven with clear and convincing evidence a change in circumstances since the termination ( in which I tried to do in 2013 and her adoption was pending with her grandmother, so they denied me) If the child has been adopted, the parent of the child must ask the court or the child must be removed or relinquished from the home before a reinstatement can happen. (in which Kailee was relinquished to me and the courts still refused to give her back )... I paid $4500 out of pocket for a lawyer whom promised me that if they denied me that we could and would appeal to supreme court. He had a case of kidney stones for 2 month's. I called him everyday and he refused to return my calls while my daughter suffered. Still to do this day he hasnt called me back . I have tried appealing it on my own and they said i missed the 30 day deadline. Had I known I only had 30 days I would of acted faster and if I had known the attorney i am still making payments too was going to mess my appeal up for me ; i would of done it myself. I will not post hime name publically, Im not like that, I just hope noone pays their hard earned money for false promises like I did.

Referenced to as Code BBK 49-6-6 a child, parent of child, the department, or the terminated parent can petition the Court for reinstatement of parental rights if it can be proven to be for the best interest of the child , (and will also include the structures i have listed below) in cases in which a child has been adopted, an adoptive parent, terminated parent or the department on behalf of the child can petition the court for reinstatement of the terminated parent if there are valid reasons for reinstatement and If it is in the best interest of the child. A terminated parent cannot petition the courts for reinstatement after an adoption or the department on behalf of the child unless there is valid reason that can be proven in removing a child from its adoptive home and creating a disruption in the child's current life. A clear and convincing change of circumstances must also be proven. Such as , a good strong emotional bond with the terminated parent, the parent must of underwent and graduated a drug rehabilitation program, and able to prove that and pass random drug screenings, visits must be consistent and of a good standing, the child must fully agree to the reinstatement , the terminated parent must have a job and worked same place for at least 2 year's and be in good standing .they must be able to prove they have a good home and can provide a safe life for the child, the must agree to be under supervision of the department and the courts for the time remaining untill the child reaches the age of 18. The department will hold weekly visits in the home and be responsible for updating reports with suprise visits also included , including pop up drug screens , ect, they must have transportation or be on a bus line in order to take their child to dr dentist ect. The terminated parent must also continue to go to NA/AA meetings, They must have no reports filed on them from cps or the law or anytype of domestic relations reports for the past 2 years before reinstatement. If any problems arise during the period that you are under probation of the department and the courts, then your reinstatement will be annulled and void and the child will be placed back with an approved guardian through the courts, and you will not be able to re-petition for reinstatement in the future again ever. If your rights were terminated due to any type of Sexually offended reasons or Murder/ you do not apply for reinstatement of parental rights ever. The courts will also consider the time the child spent with the terminated parent before adoption, and whether they devolped a bond with the terminated parent. Courts will also hold a review hearing every 6 months w the parent and department to followup with the course of reinstatement. Please help .. My babygirl still wants to come home. Hello, my name is Amanda Tate , I am a born and raised WV citizen and lived in there my entire life. I am a mother of three beautiful children, and I am also a recovering drug addict. I have over 4 years drug and alcohol free now. I have done all of my sobriety without the use of suboxine or methadone also. I owe everyday of my sobriety to the Grace of God. In the year of 2011, I was fullblown into my "addiction" and I missed a court hearing , the one in which I was supposed to be granted an improvement period. Failure to appear at that hearing cost me the rights to my three children. On Nov. 2011, the state of WV terminated my parental rights. However Dec, 2011, I admitted myself to a rehab center in Huntington, called prestera, and completed an intense 9 mth program. I remained sober, found employment and rebuilt my life. I did appeal the decision of the termination, and I ended up being granted limitless visitation, at the discretion of the grandmother of my youngest daughter, and the dad of my two older kids. The grandmother of my youngest daughter, let her move back in with me fulltime. I remained sober, continued working everyday, continued rebuilding my life for the better, and took excellent care of my daughter, she lived with me again for over 2 years. The grandmother got turned in to the Welfare office and SS office because she was recieving benefits on my daughter for the 2 years and keeping them for herself. So, CPS forced me to give her back to the grandmother. The grandmother told me they threatened to put her in jail for fraud so she had to have my daughter back. My daughter , myself, and my other 2 kids have been deeply affected by this tragedy. I never collected any of that money and I never wanted or asked for it. However, I suffer daily from pain and agony of not having my daughter. My older kids suffer because they need and miss their sister. My daughter suffers because she wants to be with me and is being forced to live with her grandmother just because she adopted her. I am begging for a law to be passed to allow for reinstatement of parental rights , after a child has been adopted in WV, as long as the terminated parent can prove a clear and convincing change of circumstances, and a evident reason for the reinstatement. I am also proposing that reinstatement should be allowed if the children are over the age of 14+ and they agree to the reinstatement. My two older children are 15 1/2 years old now and they want my rights reinstated also.
