Reform Canada's Live-in Caregiver Program

Changes to the Live-in Caregiver Program (the "LCP") will soon be proposed by the Government of Canada.  While any fundamental change to the current LCP is welcome and necessary, we are concerned that these coming proposals will fail to address the real problems created by the current version of the program.  For this reason, recommendations were submitted to the Government last spring on much needed policy, regulatory, and statutory changes to the LCP.  These recommendations address most, if not all, of the real and fundamental problems created by the LCP, for both employers and for live-in caregivers themselves.  Put another way, these recommendations, if implemented, will result in equally significant benefits to Canadians and foreign live-in caregivers alike, and thus create an LCP that actually works! We call on Prime Minister Harper and the Federal Minister of Immigration, Jason Kenney, to incorporate these recommendations into their proposed changes to the LCP, and thus create an even playing field for all!

We the undersigned, call on you, Prime Minister Stephen Harper and Minister of Citizenship and Immigration Jason Kenney, to adopt the following recommendations for reforming Canada's Live-in Caregiver Program:    
1.      Implement the Juana Tejada Law;
2.      Make the "live-in" requirement optional;
3.      Make work permit "semi-open", i.e., occupation-specific only;
4.      Make the 3-year window adjustable to allow the caregiver to make up for time lost due to unforeseen events or events beyond the caregiver's control;
5.      Repeal section 113(1)(e) of Regulations;
6.      Require mandatory information sessions/courses for BOTH employers and caregivers at any time before, or within a reasonable amount time after, the commencement of employment;
7.      Create a new self-regulating body specifically for caregiver recruitment agents and/or agencies;
8.      Extend Interim Federal Health (IFH) coverage to caregivers denied coverage by provincial health plans;
9.      Count the time spent outside Canada working for Canadian employer towards the 2 year requirement;
10.      Set up a confidential, toll free number for caregivers, to access necessary information and resources on immigration problems, and provide confidential psychological or emotional counseling;
11. Moratorium on deportation of live-in caregivers upon arrival; and counsel officers to first consider issuing Temporary Resident Permits, or TRPs;
12. Reduce processing times for work permit and permanent residence applications to ensure quicker access to workers, and family reunification to eligible caregivers;
13. Allow family members to accompany caregiver to Canada, and issue open work permit to spouse;
14. Review acceptable wage rates, as current rates are only set against minimum wage rates in each province;
15. Make the LCP a straight Permanent Resident Category, with mandatory terms and conditions; and
16.  Ratify the UN Convention on the Protection of Rights and Welfare of Migrant Workers and Their Families.
Live-in caregivers who come to Canada under the LCP care for Canadian children, disabled family members, and elderly loved ones, at the expense of their own children, disabled family members, and elderly loved ones.  They deserve nothing less than a fair and humane immigration program that will reward them for their valuable and signficant contributions to Canadians and Canadian society.
