Stop the adoption of Maria Jina-Joy Wince,
Bryan and Sabreena child in which we have been in court for three years in Stockton at San Joaquin Municipal Court, the child was born in Santa Clara County and mother was coerced to sign a paper while the father was in recovery from Lupus and Renal failure to allow another person in the same community that CPS had decided to care for the child at nights, upon the return of Bryan(Father) the child had disappeared from the family circle we as the parents set up and as parents we were worried as to where they had taken our child, so we called the local Police Dept. to report it and when they came there were CPS personal present and it was said that we had to give the child to temporary custody of CPS.
We were told to go to family services and we brought along our medical and family circle to discuss a solution to the care of the child, mind you the father had helped the mother who is wheelchair bound in the care of the baby for approx nine months without a problem and also a circle of helpers with our family.
The decision was made by CPS that the baby was to be taken to the grandma's house in escalon, ca. without the parents input once again.,
The term of temporary placement had ended and the grandma had filed in court that we as parents abandoned Maria Jina-Joy Wince which was untrue and that started what has been a three year battle in court to retain our daughter using court appointed attorney's and the case has been sealed along with the attorney's not able to be reached by phone.
We as parent's presented greyhound bus ticket and had a family helper drive us to visit our daughter and got kicked out of the hotel we were staying and the grandmother came and said that she didn't want us to come to the house where our daughter was any longer!
Although tuesday June 24, 2008 at 1:30pm is the last court procedure as the attorney's say, the parents don't intend on giving up parental rights and will take the decision to the Appellate court.
The mother has written a book about the subject on her prior two other babies that were taken by CPS and this is the first child for me as the father.
My employment is In Home Support for the mother and was not able to hire a attorney for the court procedures so we as parents have been systematically stopped from any return of our child which is in the hands of the Mariam and Carlos Soto in the town of Rippon, Ca. and has been for over five years(Maria is 6 yrs. old).
It had been claimed that we were not taking care of her health in which Stanford Hospital claimed that she was healthy, then the mother had been trying to get a wheelchair to become independent as a mother with the help of a therapist at Through the Looking Glass and it has not been granted(process not completed) and she has mild Cerebral Palsy but she had adaptive equipment donated to her to raise the child from Through the Looking Glass and visitation of the child has been almost denied.
The case has been written up in the San Jose Mercury News on Jan 28, 2008 and later a week of coverage on the problem of child loss and poor attorneys and judges in the cases in Santa Clara County and this is not half of the resistance that we have received in trying to be parents to our daughter.

We are petitioning that the biological parents of Maria Jina-Joy Wince be farely treated in the parental rights trial and that the parents recieve adaquate attorney representation and that all of the facts be brought to the trail in a truthful and fare manner for the return of their biological child to there family or relatives of their choice.
