Stop False Arrests, False Imprisonments, And Malicious Prosecutions In Washinton State

Police, prosecutors and judges, in Washington State, are using a document entitled "Certification For Determination of Probable Cause," to initiate criminal process against sovereign citizens, for use in Superior Court.

However, the state and federal laws, including both constitutions, require that a sworn affidavit be submitted, and required due process of law be administered/provided.

The certification for determination of probable cause was once used in Washington to cite traffic violators, but, was subsequently repealed, and no law was ever enacted for use in a State Superior Court, for initiating any criminal process.

The problem with the use of such a document is that, it is a self authenticated certification, which allows anyone to lodge criminal complaints without a designated court official administering a sworn oath in a court proceeding, thus, denying all due process.  Anyone is able to simply write an unsubstantiated statement of accusation, swear to it before no one, then, sign it.  Criminal legal process is then commenced, searches and seizures are taking place, and private citizens are arrested and prosecuted, when the state never acquires any jurisdiction to take any action.  The superior court acquires no jurisdiction in a criminal matter, without a sworn affidavit of complain, and provision of due process.

Washington state prisons are overcrowded primarily due to the states use of this highly unlawful process, and the negative consequences to people and their families are catastrophic.

Washington law even prohibits the use of this certification, and requires the use of the affidavit process, as does the constitution.

This unlawful process must be stopped, and governmental officials must be held accountable.  There is more than sufficient evidences of this abuse
