Issue Spencer Street Condos a Certificate of Occupancy!!!

I am outraged that the City of New York has refused to issue a Certificate of Occupancy to Spencer St. Condominium.  Without a Certificate of Occupancy the homeowners of Spencer St. are unable to sell or refinance their condos. 

They have also spent five years and nearly one million dollars trying to rectify a situation created by the NYC Department of Building (DOB) and developer Mendel Brach.

 

• The homeowners of Spencer St. should not be punished due to the failure of the DOB inspectors to enforce their own building codes during the construction process and the gross negligence of the DOB in issuing a Temporary Certificate of Occupancy allowing the illegal condos be sold to unsuspecting New Yorkers.  

• I also question why the DOB issued a Certificate of Occupancy to 218-228 Skillman Street, an identical building completed after Spencer.  Why is the DOB discriminating against the people of Spencer Street?

• Why have the City of NY and Attorney General Andrew Cuomo chosen not to file any criminal charges against the developer Mendel Brach, who defrauded the City and State of New York when filing his Offering Plans. And sold illegal and defective condos to 150 New Yorkers, making a 27 million dollar profit.

 

I demand justice for the people of Spencer St.  I ask Mayor Bloomberg, Attorney General Andrew Coumo and the NYC Department of Buildings to issue Spencer St. Condos a Certificate of Occupancy and press criminal charges against Mendel Brach, who defrauded the city and state of New York and sold illegal and defective condos to 150 New Yorkers.
