Are the NYS DMV permanent revocation penalties for DWI offenses Just?
Myself along with thousands of other New Yorkers who are permanently denied for relicensing to drive do not think so! In Sept of 2012 Andrew Cuomo and the NYS DMV made effective a regulation that permanently denies drivers with 3 DWI offenses from ever obtaining a drivers license both here in NY and the entire the country. That's right! The entire country! This is due to the NDR (National Drivers Registry) which states," Anyone who is permanently denied in NY cannot be relicenses in another state" This regulation was set in motion retroactively which means, Anyone with past DWI offenses and or speeding tickets as old as 25 years or older (Which they were already sentenced for years ago) are now once again sentenced for on a much harsher scale then what it once was when the offense was first committed.. This regulation was also put in motion well before its Sept 2012 effective date. Many people including myself, Had their relicense applications sent in to the DMV well before (Some back as far as 1 year maybe longer)the regulation came into effect but had their applications held in limbo till the effective date of the regulation.. So I ask, How can a regulation be enforced if it is not effective yet? But thats exactly what was done by the NYS DMV to many applicants. I am well aware that driving is a privilege not a right but doesn't everyone have the right to be treated fairly? With the way this regulation was put into effect, Its retroactivity, and being enforced prior to its effective date, There is no reason to believe it was fair at all.. I am not writing this letter for sympathy, I am well aware of the many stupid mistakes I've made in the past and I'm remorseful and ashamed of them. But is a permanent revocation the best answer to this issue when there are other means? There are ignition interlock devices available that will not allow a person to start their car unless they blow into a device which checks your alcohol level like a breathalyzer test.. If a person has to much alcohol on their breath it will prevent the car from starting. The device also requires the driver to blow into it every so often while driving to make sure they are not drinking while they are driving. Wouldn't this be a better more suitable means to take than to permanently restrict a person's ability to acquire or maintain gainful employment and to live a full productive life? Many may say that there is public transportation..This is not the case in many areas of NY state..People who have a license really have no idea what it is like not to have one unless they have lived without one.. There are school functions for your children, Dr. appointments, Grocery shopping, visiting friends and relatives, etc that so many people now have to rely on other people to do with them or they cannot be done at all unless they pay a fortune for cabs or Uber.. The people who are restricted from only doing the above mentioned things are the lucky ones! There are many that have lost their jobs and homes because of this regulation! Does the punishment of permanently denying drivers licenses to hard working people who pay their taxes and are just trying to do there best to feed their families really fit? New York state claims to be a very Human state with slogans such as "No one is left behind". New York provides all sorts of help and programs for people in need. Such as, People with drug dependencies, Convicts, Ex Convicts, battered women, Single parents on public assistance, and illegal immigrants... There is help for them, and the ability for them to move forward. Yet many good people, Men and Women with jobs and families that have made mistakes due to alchohol dependency (Which can effect anyone no matter what their stature) in the past and have turned their lives around in a 180 degree direction are left behind. Is it really fair to leave people no ability to prosper or make their lives better because of stupid mistakes they made as far back as 25 years ago? But yet, A ex convict incarcerated for a violent premeditated crime can do his/her jail time and have the ability to obtain a drivers license? Does this sound fair and just to you?
