Help Rescue Patricia Kobylak
On August 4, 2008, Patricia's three brothers Theodore, David and Ronald Pierce came to Patricia's place of employment, WhirlWind Music in Greece, NY (a suburb of Rochester, NY) unannounced and told her that they were taking her to lunch. Without informing Patricia they drove her to her brother David's house in Pittsford, NY (another suburb of Rochester, NY on the other side of the county). In the audio below Patricia describes herself as having no energy which we believe could possibly indicate that she was drugged. From here the brothers brought Patricia to her home and in conjunction with the Irondequoit police department (another suburb of Rochester, NY) worked together to remove Patricia from her residence at 51 Dewberry Drive and placed her in a Psychiatric ward in Rochester, NY called The Strong Behavioral Health Clinic. The involvement of the police came about as a result of a police report filed on August 3rd by Patricia's brother Theodore Pierce. Yet in my attempt to obtain a copy of this police report via a Freedom of Information Request I was denied on the grounds that the police report doesn't exist.

In this video you will hear Irondequoit Police Department Records Officer Manager Ms. Sue Rumfola and the police officer from the Irondequoit Police Department in two different clips contradicting each other. Starting at 1:50 in this video in a message left on the answering machine of Patricia's husband Timothy Bowman, Ms. Rumfola claims that the Irondequoit police were never at 51 Dewberry Drive and that is why no police report was filed. Yet in the clip with the Irondequoit police officer who happens to be a Lieutenant, he implies that the Irondequoit Police were at 51 Dewberry Drive, but that the situation was cleared as a Code 40 which according to this officer is the police assisting people to get property from their residence and usually doesn't involve filing a police report. Based on this major contradiction can what these people say be trusted at all? The problem as you will see in this video is that the police were not assisting Patricia in getting property from her residence.

During the court proceedings that happened in the ensuing months after Patricia's confinement, she was diagnosed with Dementia and legally incapacited. In July of 2008, however, Patricia was given a medical examination by Dr. Kalpana Patel at The Allergy Environmental Care Center in Cheektowaga, NY where she was diagnosed with Hypothyroidism, Hypertension (High Blood Pressure), Depression, Vitamin and Mineral Deficiencies, Autonomic Imbalance and Toxic Heavy Metal Exposure.

As you can see Patricia wasn't diagnosed with dementia. She was, however, diagnosed with Hypothyroidism. Hypothyroidism requires immediate treatment because if left untreated it mimics and can degenerate into full blown dementia. Here are a couple of links that illustrate this point:

The fact is, if Patricia showed any signs of cognitive difficulty it is a combination of her diagnoses, not because of Dementia. From the time Patricia was taken against her will and confined at The Strong Behavioral Health Clinic until the present, she has not received sufficient treatment for her conditions. While at Strong, Patricia was forbidden to go outside, she was forcefully drugged and her privacy was abused.

On December 5, 2008, after 4 months at The Strong Behavioral Health Clinic, Patricia was abruptly moved to The Shore Winds Nursing Home which is also located in Rochester, NY. Below is evidence that The Shore Winds nursing home is possibly the worst nursing home in New York State:

Now, as stated above, Patricia has been deemed legally incapacited by the court because they said she has Dementia. We have shown that at the time of the courts ruling that this was false and still is false. Yet if she did have Dementia as the court claims, why are they forcing her to take Risperdal, a drug that is used in the treatment of Schizophrenia, is not approved in the treatment of patients with Dementia and is something that can kill her?

Governor Cuomo this is a summary of what has occurred:
1. Patricia has been confined to two different facilities against her will since August 2008. 2. Patricia's court appointed guardian Linda Ricigliano admitted on record that Patricia doesn't belong at The Shore Winds Nursing Home. Here is the audio of her admitting this:

2. During this process Patricia was falsely diagnosed with Dementia. In response to this false diagnosis of Dementia, Patricia has been deemed legally incapacitated by the courts. This means that she has no rights. They can essentially do whatever they want to her. This is what has kept her forcefully confined to both The Strong Behavioral Health Clinic and The Shore Winds Nursing Home facilities since August 2008 inspite of the fact that she has repeatedly stated that she wants to go home. I, however, have Patricia's medical diagnosis sheet from July 2008, a month prior to her forced confinement that contradicts the courts diagnosis. In July 2008, Patricia was diagnosed with a number of conditions. The one diagnosis that stands out from the rest is Hypothyroidism. Now the reason this stands out from her other diagnoses is because the symptoms of Hypothyroidism mimic Dementia. If the Hypothyroidism is left untreated it can evolve into full blown Dementia. You can see how this is a problem in relation to the false diagnosis she was given. In conversations with Patricia in person before I was banned from seeing her and in talking to her via telephone after the ban it is clear that Patricia is not receiving proper treatment for her Hypothyroidism. Her mental condition has deteriorated as a result of neglect on the part of The Shore Winds Nursing Home and her guardian Linda Ricigliano.
3. Patricia Husband Timothy Bowman was banned from visiting Patricia on December 15, 2008. The reason was that the family, whose had gained control of Patricia, claims that Timothy is a threat to her safety, however, they have no evidence to back up that claim and Patricia has repeatedly stated on record that she want to return home to live with Timothy Bowman.
4. This woman's rights have been intentionally and completely abused by all parties involved. The court system, the Police, "her family", her employer, her former mental health attorney, the Psychiatric ward staff and the nursing home Administrator and staff, her court appointed guardian Linda Ricigliano of Catholic Family Services which is located at 87 North Clinton Avenue here in Rochester, NY and many more have completely treated Patricia like she is nothing but a thing; an IT. Governor Cuomo, it is truly disgusting what they have done to this humble, loving, God-fearing women.
From January 2009 until November 2009 Patricia was without a phone in her room and had to sneak calls out by other means. A phone was finally placed in her room in November 2009, however, we have reason to believe that the staff at Shore Winds has listened to her private conversations. This again is an abuse of her NYS Patient Bill of Rights. Here phone has once again been removed from her room. As a result she has been forced to sneak calls out. She has also stated to me that she has been drugged against her will. Patricia has a Living Will which states that the taking of drugs of any kind is against her Christian beliefs. Patricia told me that when she was first placed at The Shore Winds that she was made to be washed by staff members. Complete strangers that she had never seen before. This is a complete invasion of her privacy which is in direct violation of her NYS Patient Bill of Rights. Patricia has also stated that the staff at The Shore Winds has mocked her condition. She has been placed into a room where her roommate is abusive. While speaking to Patricia, I have heard the roommate screaming profanities at her. She has stated repeatedly that she wants to come home. It is clear that Patricia doesn't want to be confined at The Shore Winds Nursing Home.
Patricia was moved from the second floor to the third floor Lockdown Dementia unit and resided there from January to November of 2009, until she was moved back down to the second floor on November 9, 2009 where she resides to this day. In the past packages that I sent to Patricia have been returned. Visitation is still being restricted to the guardians authorized list.
5. Patricia is forced to wear a Radio Frequency ankle bracelet to ensure she doesn't attempt to escape. I understand that this is protocol in facilities dealing with dementia patients, but as I have demonstrated above she does not have dementia. There was one instance where Patricia was walking me out after one of my visits with her. As we approached the elevators, all of a sudden, the red light by the elevator starting flashing and a siren sounded. The elevator system was completely shut down. This noticeably unnerved Patricia. A nurse had to come by and punch in a code into the keypad next to the elevator to return things back to normal. After calming Patricia down I got on the elevator to leave. The same nurse stepped onto the elevator as well. As we rode down I half-jokingly asked her if Patricia was on house arrest. She told me that the ankle bracelet was to ensure that Patricia didn't attempt to escape. Governor Cuomo, I have been in many nursing homes and have never seen anyone wearing a house arrest like ankle bracelet to ensure they didn't escape. Anyone who knows Patricia knows that this is an unnecessary measure to take. She has never even received a parking ticket.
6. As stated above Patricia's New York State Patient Bill of Rights has been completely abused. Here is a list of The New York State Patient Bill of Rights:

Governor Cuomo, this is a 59 year old women that is more than capable enough to take care of herself and to make her own decisions in regards to whether for instance she should take drugs or not. Before her kidnapping and forced confinement Patricia drove, worked a full time job as an accounts payable clerk and was good at what she did, was a fine cook, served her family as a loyal and doting sister and daughter, served in the local church and had her own loving home with her husband Timothy Bowman and their cats. Patricia has never been a threat to herself or to others. She has never even gotten a ticket. Governor Cuomo is it moral that Patricia's life has been destroyed and her constitutional rights abused because of a false medical diagnosis?

This information clearly shows that Patricia is capable of taking care of herself. Again, I ask you, Attorney General Cuomo is it right that a women lose her rights and her very life because of lies and deception?

We, the undersigned, ask you New York State Govenor Andrew Cuomo for an immediate intervention into Patricia Kobylak's situation, a thorough and open investigation of Patricia Kobylak's case, for Patricia to reclaim all of The Rights that have been unjustly stolen from her by an unjust court ruling, to set her free so she can resume the life she once had in her own home and to investigate the misconduct of all the people involved in Patricia's abduction and unjust confinement at The Strong Behavioral Health Clinic and The Shore Winds Nursing Home.
