Auto Glass Industry National Right to Fair Trade Petition

This action is extremely important to restore free and fair trade to the auto glass industry so that that consumers will have the freedom of choice when it comes to what repair shop works on their vehicles and so that the business agreements between consumers and their chosen repair shops are not interfered with improperly and unduly. 

Whereas: Federal and State Laws espouse a Fair and Free Trade Philosophy.


Whereas: Fair and Free Trade espouses competition and restricts anti-competitive activity.


Whereas: United States Businesses have a reasonable expectation to maintain customer names, addresses, phone numbers, email addresses, prices, as well as other business transaction information as confidential and proprietary.


Whereas:  United States Businesses have a reasonable expectation to negotiate their own prices and relationships.


Whereas: United States Businesses have a reasonable expectation from being forced to transact business with and divulge confidential and proprietary business  information to competitors.


Whereas: Consumers have a reasonable expectation of freedom of choice when making business decisions and selecting auto glass repair facilities without being    subjected to coercion, innuendo, or favoritism.


Whereas: Consumers have a reasonable expectation to privacy and to not have their private business transaction information released to uninterested parties.


Whereas: Consumers should not be forced to deal with businesses in competition with their vendor of choice.


And Whereas: Auto glass windshields are an integral component of the automotive  consumer safety restraint system.


Therefore: I urge you in the strongest possible way to restore the above mentioned tenets to the auto glass industry by enforcing THE 1963 CONSENT DECREE and, if necessary, by adopting legislation that forbids violation of any of the above positions, especially the use of biased third party auto glass claims administrators, i.e. substantially and/or financially related to auto glass repair and replacement facilities which is an obvious conflict of interest.

The 1963 Consent Decree case laid out how auto insurers were violating the Sherman Antitrust Act.
Public policy was set and explained in detail what constitutes steering and undue influence. Today violations are still occurring on a daily basis. Signatures are needed to persuade the authorities to take action against the powerful insurance companies and those companies that conspire with them.
