Protecting Children is Not a Political Agenda

In the matter of the State of Nevada vs. Elaine Clermont, Case No. 249145, the undersigned presents this statement as a "Friend to the Court."
Mothers Protect Children -- Scapegoats Protect the Guilty.
Protecting children and advocating for their security in our public schools is not a political agenda, it is our civic duty.
On September 8, 2008, Jo Mackey Academy of Leadership and Global Communication and Clark County School District endangered the child she is accused of imprisoning. Elaine Clermont was sitting at home when a child walked out the front gates of a public school in Las Vegas, Nevada and was picked-up on the street by a complete stranger. That is every parent's worst nightmare.
That complete stranger, Laurinda Drake, thankfully, meant him no harm. Mrs. Drake at all times had custody of the child. Mrs. Drake did not kidnap the boy. Mrs. Drake did not conspire to kidnap the boy. Mrs. Drake did not imprison the boy. If Mrs. Drake did not commit a crime, Mrs. Clermont cannot be guilty of a crime that did not occur.
Mrs. Clermont and other parents previously warned the Clark County School District and the Board of Trustees that the school's security was inadequate and the Superintendent of the Schools refused to change it to protect its students. "I will not be requesting any change in the school's operation or administration." Response to Public Concern Form 092, by Dr. Walt Rulffes, Superintedent, Clark County School District (June 2, 2008).
On September 8, 2008, Mrs. Clermont arranged for the child to be returned to his parents through the highest authority for the Clark County School District -- the Board of Trustees. Mrs. Clermont requested that the School District contact his mother immediately and gave permission to give her telephone contact information to his mom so she could contact her son as soon as possible.
Mrs. Clermont notified the local media of this important news worthy information for parents and concerned citizens of Clark County Nevada.
These actions are not crimes.
Mrs. Clermont blew a very loud whistle at the Clark County School District for its failure to protect another mother's child. Every parent would hope that another would do the same thing to protect their own child.
Despite the judgment of Judge Stephen Dahl that there was no evidence of a crime, District Attorney David Rogers has breached the public trust, abused his office and its power in continuing to criminally prosecute Mrs. Clermont without any evidence a crime was committed.
Our courts are to protect the innocent until proven guilty. Do not allow the perversion of Mrs. Clermont's actions by the District Attorney allow Clark County School District to scapegoat Mrs. Clermont for their failure to protect our children and listen to their parents.
Judge Herndon, the undersigned asks, as a Friend to the Court, that you exercise the oath of your office and dismiss all charges against Mrs. Clermont. It is the right thing to do.
In the matter of State of Nevada v. Elaine Clermont
We, the undersigned, send this petition to you to consider in this matter, as we are concerned citizens of our communities. What you do in Las Vegas, Nevada with respect to Mrs. Clermont, you do to parents all over this world.
Parents must be able to help one another to protect our children in a community where we have weaknesses, corruption, incompetence and other malfeasance that would endanger our children. Such actions that are intended to help a child when they face such a danger should never be criminalized but should be supported in our communities.
Moms have no political agendas when it comes to protecting children. What one mom does to help another mom and their child, they hope will be reciprocated if their child is ever in harm's way. Mrs. Clermont's actions were to protect one particular child on September 8, 2008, and to protect every other child in Clark County School District in the future. Institutions and governmental agencies that fail our communities must be held accountable for their actions or failure to act to protect our children, not protected through an abuse of their power.
It is our civic duty to work tirelessly to ensure our children a safe, secure and protective educational environment. Parent involvement in our schools and their administration is the missing critical component in our failing public school system. Our posterity deserves courageous acts by our citizens today.
Mrs. Clermont is a mom. Mrs. Clermont is an advocate for children. Mrs. Clermont is a community leader. Mrs. Clermont is not a criminal for her actions on September 8, 2008.
Please do not let this injustice be endorsed by your court. Please dismiss all charges against Mrs. Clermont because it is the right thing to do.
