Demand Cyprus Tenancy Law Reform! Current Law is discriminatory against Landlords!

In Cyprus, there is a very anti-democratic, prejudiced and unfair Tenancy Law which clearly discriminates against Landlords.

The 31 year long Cyprus Tenancy Law is clearly in favor of tenants. Landlord’s rights are not protected to a fair and Democratic extent in an way. This creates a legal and civil chaos in the Cyprus society and negatively affects the Cyprus Economy. The enforcement of this new and fair law will undoubtably ensure a healthier tenancy environment of mutual respect between tenant-landlord, which in return will benefit immensely the Cyprus economy and will stop the chaos which is clearly caused by the current defective and unjust Law.

The Landlords and Owners of Rental Property in Cyprus are asking the Cyprus Parliament to vote immediately for the reform of a new and just Tenancy Law that protects ALL Cyprus citizens and residents without discrimination, without prejudice, a new Law that protects both tenants and landlords in the same way and to the same extent.

This is what to currently expect when a Landlord is trying to evict tenants for non-payment of the rent or for not honoring the lease: 
- Duration until completion of service of process: 60 Days.
- Duration of trial: 120 Days.
- Duration of enforcement of decision: 180 Days.
- Total Days to Evict Tenant: 360 days!!!!

This Law is obviously faulty and does not cover landlords in the case a tenant does not pay rent or is not honoring the lease. Many landlords rely on rental income as their sole income. How is it fair that the Law does not provide a quick remedy in order to evict a non-paying or complying tenant fast? Why should a landlord be deprived of their dwellings as well as their rental income both at the same time? Is this Democratic or Constitutional? The current Law is anything but fair!

NEW LAW REFORM PROPOSAL
- A landlord may use without reason, a 30-day notice to end a month-to-month tenancy if the tenant has been renting for less than a year. 
- A landlord may use a 60-day notice if the tenant has been renting for a year or more and the landlord wishes for the tenant to move out, within Lawful reasons and regulations.
- If a tenant is not complying with the lease terms or the rental payment, a 3-Day Written Initial Notice may be sent by the landlord to the tenant to pay or quit (For month-to-month as well as long term rentals)
- If the tenant does not cure the claimed default, or does not move out by the end of the 3-Day notice period, the landlord may immediately file an eviction lawsuit.
- The Eviction Lawsuit should have a short timeline of approval by the court, such as 30 days.
- The Duration of enforcement of the decision and removal of the tenant and any belongings from the premises by the police, should be enforced within 15 days of the issuance of the court order.

NEW PROPOSED EVICTION PROCESS:
- Duration until completion of service of process: 15 Days.
- Duration of trial: 30 Days.
- Duration of enforcement of decision: 15 Days.
- Total Days to Evict Tenant: 60 days!!!!

Law is meant to be just and to promote Democracy. The current Tenancy Law is undoubtably unjust, and promotes discrimination as well as potential friction between Tenant-Landlord.
