URGENT Support for Siraya Indigenous Legal Status in Taiwan 緊急支持西拉雅取得台灣原住民法定身分

The Siraya Indigenous peoples of Taiwan will continue to suffer cultural, societal, economic, political, and language marginalization due to the government's assimilation policies and human rights violations. Taiwan continues to assert the inherited colonial practices of the island's predecessors by refusing to acknowledge Siraya as Indigenous peoples to the land.

The Siraya peoples are one of the oldest Indigenous groups residing in Taiwan. Dutch records as early as the 1600s describe their contact with the group. The name Taiwan even comes from the Siraya language. For the past 20 years, the Siraya have urged the Taiwanese government to recognize their identity as an Indigenous group. In August of 2016, President of Taiwan Tsai Ing-wen apologized for the historical treatment of Taiwanese Indigenous peoples, and promised recognition would come during her presidency. The past more than three years of her presidency have not yet seen the rights of Siraya recognized. Unfortunately, the final session for the Legislative Yuan's four-year term opens September 17, and there's no certainty that lawmakers will pass the law to to recognize Siraya as an official Indigenous group of Taiwan. In addition, presidential elections will occur in less than four months, making this call to action EXTREMELY URGENT. The Siraya may lose the chance for recognition if legislation is not passed this session!

The Siraya are one of several Pingpu Indigenous groups that are currently UNRECOGNIZED by the Taiwanese government (listed below). In 2014, the Siraya collected almost 3,000 signatures from around the world to demand the Taiwanese government to recognize Siraya rights as Indigenous peoples as dictated under the UN's Declaration on the Rights of Indigenous People. Please sign this petition expressing URGENCY and showing your support for the Siraya and other Pingpu peoples and their mission to be recognized by Taiwan as an Indigenous peoples.

我們主張,歷代政府對西拉雅等平埔族群(暫稱如下列)因不當政策所造成的傷害必須終止,蔡政府應視其為嚴肅而迫切的任務,信守他對人民的承諾,立法院於本會期應通過原住民身分法。

西拉雅是居住在台灣的最古老的原住民群體之一,早在17世紀荷蘭文獻甚至更早的記錄多所描述。過去因為生、熟;高山、平埔的分治而錯置、隱藏甚至剝奪了平埔族群的真實身分,諸此荒謬措施早應導正歸還,可嘆時至今日在號稱民主、自由、現代的台灣政府還仍繼續延用。

過去20年餘年裡一直受政府漠視的平埔正名運動,在2016年新政府的來臨出現了前所未有的契機,同年8月1日,總統蔡英文為過去歷史的錯誤向原住民道歉,並承諾透過檢討法規讓平埔族群獲得法定原住民的地位,隔年8月17日行政院通過《原住民身分法》修正草案,盡管法案列為立法院優先審議,卻頻頻卡關,好不容易去年底完成審議送出內政委員會,然與平埔族群最為相關的第二條修訂保留協商。

而在司法途徑上,西拉雅身分案也於去年5月4日突破多年敗訴的困境,獲最高行政法院判決認為,身分乃是與生俱來不是國家所恩賜,如果西拉雅人實質上是原住民,行政院原民會應幫助他們申請才對,因此撤銷原判決,發回台北高等行政法院重新審理,但令人失望的是,台北高等行政法院還停留此案於程序繼續觀望。

在立法與司法明顯延宕之下,迫使台南西拉雅文化協會等團體繼續發起行動訴求,幾經折騰,內政委員會5月13終於召開政黨協商,但卻尚未獲得共識,依立法院職權行使法,需由院長召開政黨協商。期間,蔡總統在總統府原住民歷史正義與轉型正義委員會的會議上,屢次表達其回應正名的誠意,最近一次6月會議時蔡總統再度表示,請大家放心,他對原住民身分法的承諾不變,且進一步明確的承諾,將請蘇嘉全院長於8月底前及早啟動協商,9月會議一開始即可先處理這個法案。 眼看本屆立法院四年八個會期僅剩最後這一次會期,所見茫茫如墜迷霧,原先對蔡政府的承諾滿懷希望的族人,此刻憂心的煎熬,漸轉為憤怒與不平,這才是最真實的感受。

由於屆期不連續,而總統選舉也將在不到四個月的時間內舉行,來日充滿了變數,如果本次會議沒有通過立法,也顯示目前台灣政府尚未認定的平埔族群,在政策上將繼續遭受文化,社會,經濟,政治和語言的邊緣化,這使得這一號召連署的行動非常緊迫。!

再一次我們懇請您簽署此請願書,表達對此緊急情況的關注,並表示您對西拉雅和其他平埔族群追求真實身分的支持,這不但是普世的價值,也是島上每個人共同的使命,此事關他們及所有族群在台灣島上所應有的定位與歸屬。
