ES Cell Tower - Stop Work Order Request

Below is the petition that we will be sending to the Eureka Springs City Council. Your support is greatly appreciated!

We, the undersigned citizens, visitors, and community advocates of the City of Eureka Springs, and all relevant neighboring communities, at large do hereby:


Request that the City Council of Eureka Springs schedule an emergency meeting to initiate a 'stop work' order against Smith Communications for the construction of a cell tower at 5 Judah Street within the Eureka Springs Historic District, so that the City Council can review the validity of public claims made by Smith Communications with-regards to alleged agreements of service with the City of Eureka Springs. We make this request for a 'stop work' order in addition to the current 'stop work' order already issued by the FCC, on the basis that: 

-         Communications from Smith Communications to the Arkansas State Preservation Office suggest that the city of Eureka Springs was the sole tenant of the tower, and that Smith Communications is requesting tower approval "on behalf of the City of Eureka Springs". However, the City of Eureka Springs did NOT initiate the build request for this tower location, and Smith Communications had indicated to the city that another wireless carrier (AT&T) was the anchor tenant. 

-         Smith Communications has made public statements suggesting that letters of support from Eureka Springs Police and Fire Departments constitute a binding agreement for emergency communications services on the proposed cell tower. The letters in question do not include the specific terms, limits, or details of any such agreement, and were not approved by the City Council or Mayor. Not only do such letters of support NOT constitute a binding agreement for service with the City of Eureka Springs, but these letters of support for the Smith Communications tower were written by Smith Communications.  

-         The Mayor of Eureka Springs, Dani Joy, was led to believe that the existing Delta Tower offering free placement of an emergency services city antenna was no higher in elevation than the city's existing tower at the Police Station, when in fact it is roughly 100 feet higher in total elevation. In addition, it is higher in total elevation than the tower proposed by Smith Communications. It is in the city's best interest to utilize the existing tower to not only preserve the character of the Historic District and take advantage of the generous offer for free city antenna, but because the total elevation is higher than what has been proposed by Smith Communications.

-         The Arkansas State Preservation Office has indicated that they would not have approved of this installation if emergency services had not been included in the project, and they were not aware of an offer for similar services from the owner of an existing tower that would offer considerable overlap in coverage. If the Arkansas State Preservation Office had not supported the installation, the Eureka Springs Historic District would have had grounds for rejection of the application, and the FCC permit may have been denied by the FCC Federal Preservation Officer. 

We thank you for your time and attention to this matter, and request that you proceed expeditiously in scheduling an emergency City Council meeting to address our concerns.
