Remove the Loopholes in the NYS Climate and Community Protection Act (CCPA)!

The NYS Climate and Community Protection Act (CCPA) has serious problems that need to be fixed before its passage:

1. The definition of "greenhouse gas emission source" must be modified so the DEC cannot decide to ignore whole categories of anthropogenic sources.
2. Compliance actions taken must ensure that statewide GHG emission limits are not violated.
3. GHG reduction mandates for electricity from load-serving entities must extend past 2030 - at least until 2040 - so the needed infrastructure is in place for the period post-2030.
4. Loopholes that allow the state to miss its electricity targets must be eliminated.
5. The mandated Climate Action Council should be co-chaired by both DEC and NYSERDA, so emission limits can synchronously be tied to the state's Energy Plan and programs.
6. The "scoping plan" must be elevated to an actual plan for implementation rather than be merely theoretical and nonspecific.
7. The bill must mandate development of specific programs to tackle all aspects on a sector basis.

We ask the Environmental Conservation committees of the NYS Assembly and NYS Senate who are sponsoring NY's climate bill to amend the CCPA by closing these loopholes, and the full legislature to pass a corrected climate bill that all New Yorkers can support.
