CHARTER of the COMITTEE  - Article 481 - Falsehood in Certification

[Article 481 is the Italian equivalent of Cal. P. C. § 471.5  - Fraudulent Medical Reports – TN]

Article 1 – Constitution

The  Article 481 – Falsehood in Certification - committee in hereby established.

Article 2 – Headquarters

The committee has its legal headquarters in Montecatini Terme, Piazza XXIV Maggio n. 5, Italy. A possible change of the location does not require an amendment to this charter.

Article 3 - Goals and Objectives

The following are the objectives of the committee:

a)      to sensitize the public opinion regarding Carlo Parlanti’s case;

b)      to keep alive the attention of institutions, even international, for this judicial matter in order to reach a re-evaluation of the same and to obtain public recognition of Carlo Parlanti’s innocence;

c)       to file criminal charges with European and American Police and Judicial Authorities to obtain the prosecution of the criminal acts committed surrounding the Carlo Parlanti case. It’s worth noting that these charges are based exclusively on accusations and technical opinions published by experts that certify the commission of the above mentioned criminal facts (http://www.carloparlanti.com/publications.html)

Article 4 – Activities

The committee pursues the above objectives through:

·         every suitable initiative to attract public attention to Carlo Parlanti’s case;

·         research of information/materials/contributions that may be useful to sustain Carlo Parlanti’s cause;

·         collection of signatures, even through social networks, for the recruitment of new members, as well as the underwriting of appeals, petitions and such.

Article 5 – Presidency and Members

The founding member and President of the committee is Mrs. Michela Ginanni, born in Barga (LU) on 11/16/1984 and residing in Montecatini Terme (PT), Piazza XXIV Maggio n. 5, Italy, fiscal code GNNMHL84S556A657Y.

Article 5.1 – Member Admission

All those that are interested in the achievement of the institutional objectives and dedicate themselves to contribute to the committee’s activities, may obtain the status of committee members through the signing of the online petition # __ reachable through the internet address http://

Article 5.2 – Loss of Membership

The status of member ceases for:

a)      resignation,

b)      death,

c)      lack of moral suitability,

d)      behavior contrary to the interest of the committee and its objectives and/or statutory rules. The evaluation of the concrete subsistence of hypotheses c) and d) is carried out by the committee members, the simple majority of which will deliberate such exclusion.

Article 6 – Non–Profit Status

The committee is a non-profit organization.

All committee activities are performed free of charge by its members, without any right to compensation.

Article 7 – Deliberations

All decisions regarding the life of the committee and its activities are taken by a simple majority of its convened members. In case of a deadlock, the vote of the president will prevail.

Article 8 – Dissolution

The dissolution of the committee will  be decided by a 2/3 majority of convened members.

Article 9 – Additional Rules

For anything not expressly included in this charter, the rules of the Civil Code and complementary laws apply.

STATUTO del COMITATO
“Articolo 481 - Falsità in Certificati”

ART. 1 – Costituzione

E’ costituito il Comitato “Articolo 481 - Falsità in Certificati”. La lista dei membri fondatori e’ visibile  all'URL http://www.carloparlanti.it/soci-fondatori-comitato-art481.html

ART. 2 – Sede

Il Comitato ha la propria sede legale in Montecatini Terme, Piazza XXIV Maggio n° 5.

L’eventuale variazione della sede non comporta modifica dello Statuto.

ART. 3 – Finalità e scopi

Scopi del comitato sono:

a)      sensibilizzare l’opinione pubblica sul caso di Carlo Parlanti;

b)      mantenere viva sulla vicenda giudiziaria l’attenzione delle Istituzioni, anche internazionali, onde pervenire alla rivalutazione di essa ed al pubblico riconoscimento dell’innocenza di  Carlo Parlanti;

c)      presentare denunce presso le autorità di Polizia e Giudiziarie Europee ed Americane per ottenere la prosecuzione degli atti criminosi commessi al contorno della vicenda Carlo Parlanti.

ART. 4 – Attività

Il Comitato persegue i suddetti fini attraverso:

-         tutte le iniziative idonee a richiamare l’attenzione pubblica sul caso di Carlo Parlanti;

-         ricerca di informazioni/materiali/contributi che possano rivelarsi utili per sostenere la causa di Carlo Parlanti;

-         raccolta di firme, anche tramite social networks, per l’adesione di nuovi membri, nonché per la sottoscrizione di appelli, petizioni e simili.

ART. 5 – Presidente e Membri

Membro Fondatore e Presidente del Comitato è la sig.ra: Michela Ginanni, nata a Barga (LU) il 16/11/1984 e residente in Montecatini Terme (PT), Piazza XXIV Maggio n° 5, C.F. GNNMHL84S56A657Y.

ART. 5.1 – Ammissione membri

Possono, acquistare la qualità di membro del Comitato tutti coloro che sono interessati alla realizzazione delle finalità istituzionali e si impegnino a collaborare all’attività del Comitato, previa accettazione incondizionata del presente Statuto tramite la firma della petizione online N°__raggiungibile dall'indirizzo internet: http://___.

ART. 5.2 – Perdita della qualità di membro

La qualità di membro cessa per:

a)      dimissioni,

b)      morte,

c)      indegnità morale,

d)      condotta contraria agli interessi del Comitato, ai suoi scopi e/o alle norme statutarie.

La valutazione circa la sussistenza, nel caso concreto, delle ipotesi c) e d) è effettuata dall’insieme di membri del Comitato, che deliberano l’esclusione a maggioranza semplice.

ART. 6 – Assenza di scopo di lucro

Il Comitato non ha scopo di lucro.

Tutte le attività proprie del Comitato sono svolte gratuitamente dai suoi membri, senza diritto a compenso alcuno.

ART. 7 – Decisioni

Tutte le decisioni concernenti la vita del Comitato e la sua attività sono assunte a maggioranza semplice dei membri riuniti.

In caso di parità, prevale il voto del Presidente.

ART. 8 – Scioglimento

Lo scioglimento del Comitato è deliberato dalla maggioranza di 2/3 dei membri riuniti.

ART. 9 – Rinvio

Per quanto non espressamente previsto dal presente Statuto, si applicano le norme del codice civile e leggi complementari.
