Constitutional Law vs. Question 3
On September 14th, 2010, Ramona Moore Baker won the office as Judge of the Orphans Court for Baltimore City. Under the Constitutional Law of Maryland, under the Maryland's Orphans Court, Ramona Moore Baker's name was submitted before the board of elections in Baltimore City. After Ramona Moore Baker's successful primary win in Baltimore City, Ramona Moore Baker's name was submitted to the board of elections for the general elction held on Novenber 2, 2010. Ramona Moore Baker won the office as the first non -member of the Maryland bar. During the general election a referendum was placed on the ballot that further increased the qualifications for the future elected candidates for the Judge of the Orphans court. This referendum would include that the requirements for Judge of the Orphans would be" members of the Maryland Bar, live in Maryland for 12 months, practice in Maryland and be in good standing. Governor Martin O' Malley, numerous Senators and the members of the house of Delgates from Baltimore City were responsible for having this bill passed. Yet, thousands of residents in Baltimore were fully unaware that this bill was being presented.
However, there were many flaws to the referendum that passed on November 2, 2010 the same day that Ramona Moore Baker won the general election.
