Submitted to the Oregon State Marine Board on February 13, 2017, The Rogue Fly Fishers organization and landowner Greg Layton filed a Petition for a Law change that bans the use of powerboats (ie: pump propulsion) on the Upper Rogue River from the Touvelle Bridge, upstream to the Cole Rivers Hatchery. If successful, this ban will prevent thousands upon thousands of people from recreating, learning, and earning a living as fishing guides and outfitters. RE: Petition Submitted to the Oregon State Marine Board by The Rogue Fly Fisher organization and Mr. Greg Layton on February 13th, 2017 that proposes a law change preventing recreational river users and commercial outfitters and guides from using powerboats (pump propultion) on the Rogue River.
The Rogue River as established and kept intact, is a multiuse river in which all users have the right to enjoy, independently from one another, while also cooperating within the confinements of Oregon laws, sportsmanship, and the fundamental understanding of the published guidelines for using the multi-use river.
The petitioners have very little knowledge of that section of river between the Touvelle Bridge and Rattle Snake rapids in general, based on their statements as to the type of boats historically used on that section of river or type of river users. The utilization of the term “Historic Uses” or “Traditional Users” to prove powerboats ( pump propulsion) were not part of those terms is, in of itself a clear indication they are not providing the correct information to the Oregon State Marine Board.
The “Rules of the Rogue” are cleary displayed on Oregon State plaques at the top of the Touvelle boat ramp. Using very simple language to educate people on how a multi-use river works. The responsibilities of each user as it relates to one another.
The section of river between Touvelle Bridge and Rattle Snake rapids is without any doubt, the least traveled section of river we have on the Rogue, excluding the wilderness area. In consideration of that, this stretch of river being approximately 6 miles in length also contains over 4.5 miles of natural, inaccessible, or very inconvenient to reach river bank for the public. The Fly Fishers mention of congestion, blind corners, or description of possibly two dozen locations above Touvelle Bridge that would contain these conditions, is a vast exageration or non existent.
The Fly Fishers' illustration regarding the types of powerboat uses in other areas of the Rogue River (particularly the lower Rogue), listing how many miles of river those power boat users currently occupy in the river system seems to indicate they just want something for themselves.
The petition as a whole is based on speculation. It is our belief this petition does not hold merit and could arguably be described as self-interest.
It is our hope this opportunity brings forth an ability to educate people about their roles in a multi use river situation. Not all river users are educated about their inherent responsibilities as a river user under these conditions.
The people that have signed this petition agree with this petition and oppose any rule changes as submitted to the Oregon State Marine Board on February 13th, 2017
